Hi!

I filed for AOS through my USC wife July 3rd, received NOA's and Biometrics appointment (for 08/07).

Now I am 100% positive I filled out everything correctly and included all necessary form/docs as I checked and rechecked everything multiple times (so did my wife).

However 07/17 they sent me an RFIE for a copy of my Birth Certificate!

btw. I am Finnish, Finland doesn't issue BC's per se. I had to order a custom "population extract" document which states all neccesary info and is certified as such.

Anyway, because of the slightly unusual nature of my "Birth Certificate" I included an original copy (stupid, I know) because I had two of them.

SO... the same day I received the actual RFIE (yellow piece of paper) I sent it back with a photo copy of my remaining "BC". This was delivered and signed for last friday.

But my USCIS status has not been updated to reflect this.

Has anybody else had similar problems? if so how long does USCIS generally take to update ones status?

I don't really have an answer for you, but I have noticed that what they accept at the Thai consulate as proof of birth is a much lower standard than what USCIS will accept. In other words, I have seen people have no problem with a document at NVC or the consulate, and then get an RFE at the AOS stage due to the same proof of birth.

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

You don't mention -- Was it translated into English and did that translation follow the translation requirements?

June 4, 2009: Interview - APPROVED!!!

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

UPDATE: Just Received a CRIS Update, they received my photocopy of the BC they already had the original of, and they have resumed processing!

Hi Fordman! We're in the same area, and my husband is Finnish (not here yet-we just got married in Helsinki). We were just talking on the phone today about his BC (I'm just now sending in the I-130 so we don't need his BC yet). I just told him to get a certified copy of his, but from your post I understand they don't exist! How do you get the "population extract" or whatever is needed? Anyway, nice to meet you and good luck!!!!

Our timeline:

2/88: We met in Sydney, Australia at a youth hostel! He's Finnish, I'm American-both were in our early 20s at the time and fresh out of college (so couldn't afford to visit each other's countries after that!). We had a three-day romance, then went our separate ways. He actually was going to Sydney a week later, but decided at the last minute to cut his trip short in another country and go early. Wow.

1988-1998: Wrote "snail mail" letters/sent Xmas cards, but lived our separate lives. I married someone else, divorced in 2006...he lived with someone for years and then that ended.

10/08: Because of a series of random life events, I Googled my Finn Man and found him (but no link to his email, and the website his name was on was in Estonian so I couldn't even read it!). It took me two weeks to find a link to someone else, who forwarded my email to him (we were both single at the time thankfully!!!!). The email went to his spam folder but he happened to check it that day and responded back to me immediately! This was after 10 years of no contact and almost 21 years of not seeing each other after we first met.

11/08-5/09: We traveled back and forth to visit each other. Love at first (second?) sight!

7/09: Married in Helsinki, Finland...after meeting randomly 21 1/2 years ago and finding each other again!!!!!

8/13/09: I-130 sent!!!!!!!!!

Hi!

Yeah for whatever reason Finland doesn't do BC's anymore. However your Husband can go to his local Maijistratti (spelling?) in Finland and request a population extract. I would recommend that he gets at least a couple of them as BC's are quite essential for getting DL's and such started here in the States and unfortunately they are quite pathetic looking documents (just a computer printout with stamp), so invariably the DMV and USCIS are all going to want originals (which they NEVER return). Expect to pay around 30 Euros a pop for them.

I'd love for him to meet other Finns when he moves here! I'm sending his application this week sometime.

It took me two weeks to find a link to someone else, who forwarded my email to him (we were both single at the time thankfully!!!!). The email went to his spam folder but he happened to check it that day and responded back to me immediately! This was after 10 years of no contact and almost 21 years of not seeing each other after we first met.

11/08-5/09: We traveled back and forth to visit each other. Love at first (second?) sight!

7/09: Married in Helsinki, Finland...after meeting randomly 21 1/2 years ago and finding each other again!!!!!

8/13/09: I-130 sent!!!!!!!!!

To be honest I'm not a very authentic Finn. I have the passport because I was born there, but I have never lived there longer than six months.

But it would definitely be fun to meet up. Where are you going to be living? We are out on Whidbey Island.

Your status may never be updated. Ours never was. We are still "pending" for the petition approval!!! They have your BC as indicated by signing for it, hopefully it is zall they need

Well it finally got updated, did my biometrics last friday, and today it got "touched". With a bit of luck I will get my work permit soon... be nice to earn money again!

We got an RFE for BC (which they already had) - responded with a copy of the same thing we had sent originally and, like you guys, processing resumed... :wacko: (For some reason, this is a not so uncommon RFE and result)...

Hey Ford, I just saw your response! Well, my hubby can teach you more Finnish then! ha I'm in Seattle-so he'll be living here in the big city. I love Whidbey Island! In fact, that's one of the first weekend getaways I want to take him on. We'll come say hi to you when he gets here!

He ordered his birth certificate (from that "m" place in Helsinki)-four copies, I think! But you got an RFE for the same thing, or they just misplaced your original?

We submitted the appropriate certified population extract from Finland but it was rejected by NVC.  They asked for the original document and the English translation.  Unfortunately my husband got the English translation of the extract from Finland instead of it being in the native language.  We are now ordering a new copy in Finnish.  I am crossing my fingers that works.  He has no records from the time he was born and his mother has dementia.  He cannot go back and get schools records from 55 years ago.
