The border agents at airport immigrations are not aware that an I129f or K1 application is in process.

I don't think there has ever been a clear answer on this. Do you know for sure that this is the case?

TIMELINE:

December, 2008 - Started talking on plentyoffish.com

March 25, 2009 - Left Australia to to meet her

March 28, 2009 - Finally met in person!!

April 30, 2009 - Engaged

May 4, 2009 - Returned to Australia

June 26, 2009 - Filed I-129F

July 6, 2009 - NOA1 Received

July 25 - August 12, 2009 - Janet visited Simon is Australia for 2 and a half magical weeks. Met the family and is loved by all of them! :)

September 18, 2009 - NOA2!!!!!

September 28, 2009 - NVC Received

October 1, 2009 - NVC Sent

October 7, 2009 - Consulate Received

October 14, 2009 - Medical

October 17, 2009 - December 8 - Simon visiting Janet in the U.S

December 11, 2009 - Packet 3 sent

December 18, 2009 - Packet 4 received

January 12, 2010 - Interview date

January 14 2010 - Visa Received

January 23 2010 - US Entry

February 7 2010 - Marriage

I don't think there has ever been a clear answer on this. Do you know for sure that this is the case?

I would say as far as airport PoE's they are unaware of this. My fiance arrived at JFK from Moscow a week ago. The officer asked nothing about our petition. The only question he asked is why she had returned in 3 months after her last departure, in which she answered "To finish visiting the places I did not get to see last time I was here last time." The officer didn't ask her to see a return ticket or anything related to our K-1 petition. Smiled and gave her a 6 month stamp on her I-94. Although I don't think they have the petition info on the computer, they can ask and if for some reason they do ask your S/O should be prepared with all the proper documents and to answer all the questions honestly, just do not offer more info then necessary. Remember, you don't have to tell the CBP officer everything, just the info he/she is asking. If they ask. "Why are you here?" for a b-2 visa your answer should be nothing more than talking about tourism because that is what a b-2 is for, if you go on about "I'm here to visit my fiance....." this may raise red flags in the mind of the CBP officer. Although, if the officer asks, "Whom are you visiting?" you should answer "My fiance". But again, I did about a months worth of research on visiting while having a pending k-1 petition from a non visa waiver program country., there are multiple factors that play in to this but this is very possible.
