Need help with the uscis

Hi,

I am not sure if I am in the right area or not but I need help. My husband is Syrian and was denied his k-3 visa. They told him that were sending it to the nvc and then to the uscis for request to review and addional proof. I contacted the senator and found out that what they are doing is a back ground check. they told me that they would have a decision in 120 days. the 120 days are up and they told us they haven't recieved the papers yet and I asked them for the number to track it and they told me that since it has been past 120 days we would have to fill out a form and it would take an additional 45 days to get an answer for the trace number. why are they asking for the additional 45 days? Who can I contact to obtain the tracing number? We can have the background check speeded up on the Syrian end if we can get that number. are we going in the right direction waiting the uscis or would it be better to drop this one and re-file another i-130
