Filing for CR1 after K1 Denied

Timeline

We have been denied our K1 application. We have not received our denial letter and have asked countless times to receive it.

I am at the point now to just accept the denial, get married and file the CR1. Someone had once posted that they had done the

same thing, however their CR1 got hung up because USCIS had never properly closed their K1 application after they denied them.

Does anyone have any experience with this situation?

Yeah, it really does depend. For example, if it was denied and sent back for being expired, then it depends on the service center. Ours was sent back because of lack of evidence, and it was expired. Since ours was from California, they have sent us an expiration letter, which, much to my surprise, took only 5 months and 11 days to receive. Now, I know someone who was sent back at the same time, for the same reason, but to the Vermont Service Center, and their case was revalidated and sent back to the beneficiary's country.

I said all that to say, it depends on why your case was sent back. And also since you were sent back to Vermont, you may want to wait to see if it gets re-validated, because VSC is on a roll.

Honestly, we did not wait, but lucked out that CSC has let our case remain expired, and advised us to refile if we wish :star:

I did just look at your timeline, so my above advice also depends on what stage your case was denied. I am not sure if you have had your interview. If you haven't interviewed, but it was denied at USCIS, then my post is null and void.

No one is going to be able to give you any information until you tell us why your K-1 was denied. Unless you overcome the denial, the reason your K-1 was denied, then getting married will make no difference anyway. Please let us know more so we can assist you.

The first thing you need to do is CORRECT the reason you were denied, which means you need to know what it is in order to fix it. Most (but not all) reasons to deny a K-1 will also "follow" a CR-1 and cause a denail there also.

Unless the reason the you were denied was that you were not married (not possible with a K-1) there will be something else you need to correct. Getting married does not make any other problems "go away".

Agreed :thumbs: We sent in 11 pounds of paperwork showing bonafide proof to overcome our obstacle. So, yes, you must overcome whatever reason you were denied.
