Off Topic behaviour - as these last two posts illustrate - are not allowed in the Upper Forums. This is considered inappropriate behaviour when the objective of these forums is to provide assistance and not to joke or make fun of either the process or any of the respondents. Judgments notwithstanding, the OP's best bet is to return immediately to Jamaica. Let her husband file the I-130. If his petition is approved, by then she should already have hired a top flight attorney in Jamaica to deal with the issues of fraud and overstaying. Our immigration laws and regulations are right now the most restrictive in our history, but it wasn't so ten years ago. There is a slight possibility that the Department of State would take into account her lifestyle in the US while here illegally -- did she work, pay taxes, lead an acceptable lifestyle, etc. etc. That would be for her lawyer to work on, not someone from VJ.

I came here almost 9 and a half years ago in someone else's passport from Jamaica. The problem is I have absolutely no evidence to proove this and no way of getting any. I guess I will be filing as EWI. I've been married for a year now and I have two kids that are not my husband's. Lawyers advised us that I have to go back to Jamaica for my interview after everything's been filed. Can someone help me get started with this lon process, what information to get to prepare to file the I-130. Has anyone ever filed a case like this without using a lawyer? I know we'll have to prepare a waiver packet but what's the first step,thanks.

You can file the waiver, pay the fine and say your prayers. Good Luck.

Let me get this straight. You came here to the USA on someone else's passport. The US Immigration may view that as fraud and if that is the case you are not here legally. Then a relative could use the I-130 to bring you here legally. If you go back to Jamaica or even try Customs and Immigration my notice something. If they do, I am not sure what will happen. It just maybe that you will not need to worry about the I-130 petition.

That question is completely irrelevant to the OP's question and out of line. Why? It is not any of our business, and she did not ask for parenting or relationship advise.

But...I soooo badly want to know!! And I wasn't going to give parenting of relationship advice. (

P.S. You must really learn the difference between advise and advice.)

I would go back to your country and find an attorney. If your children are still young and need their mother; then they are your priority. Without sounding judgmental, you had to have realized your own situation before you made the decision to marry this man. Sounds like you have a complicated issue and you need to take it one step at a time. Follow your legal team's advice, After all, you are paying them.
