Question about I-864 fees - Concurrently filing I-130 & I-485 for Parents

Hi

Just when i thought i had all the ducks in a row, here is another question -

Since I am filing my parents I-130 and I-485 concurrently (while they are here in US) and the supporting I-864 form, it seems that i need to send additional fees of ($70) for the domestic review of the I-864 form.

"Affidavit of Support Review (only when AOS is reviewed domestically), Form I-864 : $70.00 " - text extracted from the Department of State website.

Could anyone confirm if I am interpreting this correctly. please advise - who should i write the check to ? USCIS or Dept of State?

7/29/2009: Parents AOS Application – I-130, I-485, I-131, I-765, G-325A submitted to Chicago Lockbox

7/30/2009: Package Received by USCIS – Chicago Lockbox

8/23/2009: 8 NOA Received for all submitted applications and checks

8/23/2009: 1 additional NOA received – rejecting the extra check sent (check returned)

8/27/2009: ASC Appointment Notice for Fingerprints (both)

9/17/2009: Fingerprints taken for both

9/21/2009: ASC Appointment Notice for Fingerprints (dad only)

10/2/2009: Advance Parole for both parents received

10/07/2009: EAD for both parents received

10/17/2009: Fingerprints taken (dad only)

10/23/2009: Request for Applicant to appear for Initial Interview (both parents – 2 separate letters)

10/26/2009: Police Letter requested for Dad

11/04/2009: Police Letter requested for Dad

11/30/2009: Interview completed

11/30/2009: Parents passports stamped with approval for GC

That is my understanding.

AOS Timeline

4/14/10 - Packet received at Chicago Lockbox at 9:22 AM (Day 1)

4/24/10 - Received hardcopy NOAs (Day 10)

5/14/10 - Biometrics taken. (Day 31)

5/29/10 - Interview letter received 6/30 at 10:30 (Day 46)

6/30/10 - Interview: 10:30 (Day 77) APPROVED!!!

6/30/10 - EAD received in the mail

7/19/10 - GC in hand! (Day 96) .

I asked this question previously, and was told there was no need for the $70 if it's the USCIS (not the Department of State) reviewing the I-864. See this thread: http://www.visajourney.com/forums/index.ph...634&hl=BT78

We did not send any $70 as we were advised, and had no problem with our application. Hope this helps. :)

Timeline

You do not pay the $70 when you are filing the I-864 for AOS. The $70 is for processing fee when it is done through NVC for Immigrant visa.
