which one, Senator or Congress man for help?

hi all,

I case was send back to USCIS about 6 months now. It seem like the case will sit there. I heard many people have waited from 1 to 2 years before they can appeal. I want to know which one is best to ask for help if your case is pending too long, the Senator or Congress??? Or can I ask both for help?

Ask both but IMHO, they can't do much to help except make endless enquiries with the USCIS. Our case took 2 years before it got reaffirmed but keep on pestering your member of congress and senator. I wish you all the best.

Don't forget that you have 2 senators and one congressperson. Contact the office of all 3. From reading others here on VJ there is usually one office where there is a good immigration liason.

It depends on how your representative has his office set up.

My senator's immigration specialist was GREAT.

Congressman office was worthless. All blow and no go!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I would agree you have to contact all 3, I my case my congressperson's immigration specialist spent a lot of time explaining it all to me. while the other would not ever return my email. I will remember that coming voting time :P

In my opinion, 6 months is too soon to get representatives involved. Its just barely out of the normal processing time. You should exhaust all avenues available to you first. Infopass, 1-800 number etc. Ombudsman (they won't help but it will show that you tried) Also be aware that representatives may have limited influence on your case. What they should be able to do however, is get a clear status of where the processing is. All this said... You have nothing to lose contacting them, so you might as well go ahead. Just don't get your hopes up too much...

In my N-400 case, my congressman was able to get me the "official" FBI name check status. It was merely a spreadsheet that said "processing". I kind of knew that already!

I-130 For Spouse

10-30-90: Petitioner enters US via NAFTA 1, later H1-B

10-26-96: Petitioner becomes LPR.

07-06-06: Delay due to N-400 processing begins. (Background check delay)

03-03-07: Married

06-09-08: Apply as LPR

02-26-09: Petitioner becomes US Citizen. Delay due to N-400 ends. (2 yrs, 8 mo)

02-27-09: Infopass. Attempted upgrade. Did not work. (found out later)

03-24-09: Timeline for USC I-130 begins. Faxed in Upgrade.

04-23-09: Infopass. Verified Upgrade. Never any official receipt.

06-23-09: Infopass. Check history. Nothing new.

07-23-09: NOA2

NVC IR-1

08-11-09: Case Received & Number Assigned

08-12-09: In AVR. Gave operator emails.

08-13-09: Email received: DS-3032 & AOS bill generated. DS-3032 emailed. AOS bill paid.

08-14-09: DS-3032 sent overnight, I-864 sent overnight

08-18-09: DS-3032 accepted, IV bill generated. IV bill paid.

08-19-09: Email recieved: DS-3032 accepted & IV bill.

08-20-09: DS-230 sent overnight

09-01-09: Case Complete

09-02-09: Email received: Interview Date.

Manila

10-08-09 -10-09-08: Medical. After chest xray, further testing required

10-13-09 -10-15-09: Sputum Tests

10-19-09: Result of Sputum smear test. Negative.

10-19-09: Original Interview POSTPONED

12-10-09: Result of Sputum Culture Test

12-16-09: Medical Appt.

Call them both and proceed with a formal request from the Senators. They will get answer in 24hours(It's law). Also if you feel that someone has mis handled the paperwork you can get them to help you with an appeal. I didn't have to get this far but I was told at this time it might be time to get an attorney the deals with immigration. He can do a little more then you can. He knows the system too. Good Luck!

I was in a similar situation. VSC updated their handling time to 5 months, and our application had reached 6. At that point, I called VSC and requested an "inquiry". They said they would look into it and provide me with an update within 30 days. I also received a letter from VSC, indicating that my case should be handled within another 5 months!

I decided to contact the Congressman's office for my district. The aide in charge of immigration matters there was quite responsive, and extremely helpful. She called VSC (I believe they have a specific department for inquiries from members of Congress). Long story short - that happened on a Thursday, and my I-130 (and, somewhat useless I-129F) were approved by Tuesday!

While I'm sure the results vary based on the situation, I think it's helpful to reach out to a Senator or Congressman/Congresswoman's office.

after 6 motnhs contact CIS Ombudsman, senator or congressman office are now used to seeing this types of requests. The y mgith work they might not. But Ombudsman works 100%. Director of cis ombudsman reports to president. They will reply you with oin 4 weeks garantee.

But Ombudsman works 100%.

They were no help to me. The reply was probably outside of 4 weeks, and they said to wait for my background check to complete. This was after 2 years in name check. Useless.

When the posted time was 6 Months wait my congressperson's immigration specialist told me to call her back in 4 months and she will look into it. I think it depends on who you congressperson is. if they are junior or senior member, what committee they are on. I found Paul Kanjorski to be the best help. Arlen Specter and Bob Casey, Jr. both juniors, would not even answer my emails to them. I remember that come voting time haha.

But all in all if your are stuck somewhere in a name check, I really think they can not override the FBI. If is sitting on a slow person desk somewhere on the bottom of a pile just waiting to get a stamp of approval I think that can help.
