Hello everyone.

i filed a petition to bring my fiance from pakistan to california in mid july of last year. my family and i are working with an immigration lawyer as well.

Here is what has happened:

-all the necessary paperwork were filled out and were sent to the islamabad embassy.

-The petition was approved on dec 31, 2008...he (my fiance) then got a packet in the mail with info he needs to fill out and return to the embassy in order to get an interview. Again, our lawyer filled it out and sent it.

-He got the interview date on may 4th, 2009.

-The agent said that he needed to turn in a police report and to fill out the ds forms again b/c the ones that the lawyer sent did not have the barcodes on them.

-He filled out the forms and turned in the police clearance/report on may 23 and got confirmation that the embassy got them on may 25. they kept his passport and have it until this day.

we havent heard from the embassy since may25th. we were tolled by our lawyer that it takes about a month to process everything. it has now been OVER two months and still havent heard anything. I called the Washington DC office about 2-3 weeks ago to get the status and the lady said Administrative processing.

What is taking sooo long? i knwo people from the same country whose fiance has came from within 6 months of filling the petition, without a lawyer. We are paying a lot of money for them to help us, but looks like it isnt doing any good.

i have called the lawyer and basically was frustrated. He said it is weird it is taking so long but if there was an issue they would not have still have his passport.

i am going to call the DC office again tomorrow and see whats up. its pissing me off.

please help me...im going nuts.

If you are in AP it could be a little while. Its an extended background check that they put some people through, some randomly, others because of name similarities and that sort of thing. I suggest reading up on the AP section of this site to see what its all about and what timelines you might be expecting. I hope the rest of your journey speeds up :D

If you are in AP it could be a little while. Its an extended background check that they put some people through, some randomly, others because of name similarities and that sort of thing. I suggest reading up on the AP section of this site to see what its all about and what timelines you might be expecting. I hope the rest of your journey speeds up :D

If you go to the Waiver Forum here on VJ you'll find a tracking post and others who have posted about AP. AP is administrative processing and seems to take anywhere from two months to ....well, whenever! I don't know too much about the ins and outs of AP, but it appears that this is a common occurrence in yours/or your fiances country. Please look in that forum for help and support in that specific area. All the best! (F)

AP can go from 2 months to several months, and there are few that are hitting the "year" mark.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

he might be stuck in name check.. It culd take from few mons to year +.. this is v v common w/pakistani beneficiaries.

we had to wait SIXTEEN months after the interview to rec'v visa in hand.i'A you won't be waited this long

Hey there is no time line for AP. No one really knows how much will take time. I will say tell your Fiance to call Embassy once in a week and some will give him/her info. Goodluck :thumbs:

Hey by the way, Dont just depend on LAwyer. Keep trying your self.

Let's try that again....

I am also waiting for a fiance' from Pakistan. Our petition was approved on Aug 08, Interviewed in Dec 08 and placed in AP since. All beginnings of the proces went very well, now just waiting in AP for 9 months. His brother who had come to the USA on a K1 visa in Feb 08 was only in AP for 6 weeks. There is no way to know how long it will take or anyway to make it go faster. Be patient and enjoy the life you have now while waiting for him. Getting obsessed with the timing of AP can really make for some miserable days, weeks, months.

Is there any guidelines to who may go through AP? I mean is it by country, commonality of name, etc. I am the USC and my last name is fairly common, would that mean that the application would go through more checks because of this?

its the beneficiary that goes through the checks. Its more common in certain countries because of so many people having similar names and some of them not having as easy of a time to sort through records, but they also pull random people to do AP on as well. Its fairly easy for them to determine who the petitioner is based on SSN numbers and such.

my parents told the lawyer to send the embassy in pakistan a letter about the delay.

i also call several times a week.

i dont understand how some people dont even have to wait and then some people have to wait a long time, who are the same gender, age, ethnicity, and from the same location and area.

i read on the website of us department of state for visa wait times for islamabad,

"Processing wait time DOES NOT include the time required for administrative processing. These procedures require additional time. Most administrative processing is resolved within 60 days of application. When administrative processing is required, the timing will vary based on individual circumstances of each case. Therefore, before making inquiries about status of administrative processing, applicants or their representatives will need to wait at least 90 days from the date of interview or submission of supplemental documents, whichever is later. Processing wait time also does not include the time required to return the passport to applicants, by either courier services or the local mail system."

he had to send in additional papers that were received on may 25th, but his interview was on may 4...the 60 days are counted from may 25th correct? and do u count weekends? i thought being born and raised here, would give my fiance a easier time getting his visa....its been over a year!!! he needs to come here already!

---- Me too! im getting pissed now, its almost a month but i havent heard anythng from them, the last email that they sent to me was its in process! we paid for everythng and the interview was successful.. and still now no visa and my passport!! :(
