I have no qualms about whether or not this arrest was illegal or not. I think I wrote something to the tune of that above. Lets keep things clear- was this a necessary arrest? No. Was it really justifiable? I think not. Again, the whole point of the cops knocking on that door...

... ended with the ID being verified. Deal with an irate old man in the process... well whoop ti doo.

File a strange police report in the aftermath... even more odd.

Here are a few things you posted which leads me to believe or anyone for that matter that you did have qualms about if it was legal or not.

Arresting someone without a legal reason to do so is pretty stupid in any logical book.

He had a legal reason.

Besides... a man's home is NOT public property, one more shining oddity in the police report. Therefore, a disorderly conduct claim as a legal precedent for an arrest on public property is further without merit.

I see where the misunderstanding may come from. Mea culpa.

The article you posted is rather clear. Its interpretive. Like everything else we've been beating around in the circle around the fact that the arrest should not have occurred after the ID was checked. Couple that with a police report that contradict the caller's claims and well... it throws quite the technicality into the mix.

End of debate for me. I can see that not a whole lot of folks are interested in this.

the 911 operator was kind of weird... "what do the suitcases have to do with anything?" um, that is what the lady saw...

Yes the 911 operator was weird and rude. I think what the lady was getting at with the suitcases is that people dont rob houses and bring there suitcase so it might not be a robbery, she also made a comment that maybe his key didnt work.
