I'm trying to get all my paperwork together for my wife's I-485, I-131 and I-765. I have a handle on everything EXCEPT the medical requirements.

She had a k1 physical in Kiev in Feb of this year. She obtained her K1 in Feb, arrived in the USA in April, and we married last night. (day 85 of her 90 day limit!)

I have read many places where she does not need a physical, just an I-693A vaccination supplement. I have read where K1 holders should take a DS-3025 to a civil surgeon and get the information transferred over to an I-693A. We don't have a DS-3025, or if she got one she has no idea where it went or what it was.

I have her medical records from Ukraine and with a certified English translation. She has all of the needed vaccinations already. Should I take her, the vaccination paperwork and translation to a civil surgeon and get them to complete an I-693A? Anyone worked with a civil surgeon and having them accept foreign vaccination records? Her records are all stamped as being official and from a hospital in Ukraine. The translation is stamped, certified and bound to the original.

You will definitely need to go to a civil surgeon and have them fill out the I-693A using the documentation you have. If for some reason they won't accept it, then you may have to get the immunizations all over again. Hopefully they will accept the papers and translations you have. There may also be a fee to transcribe that information.

Just to make sure that there is no misunderstanding:

You'll have to go to a USCIS approved civil surgeon, not just to any US doctor....

There's a list of approved doctors on the USCIS website.

Sorry if you knew this already but I thought I'd mention it just in case.....

Better hearing something twice than having to do extra work because there was a misunderstanding at first, right? :)

Oh, and by the way, several German friends of mine also didn't get the DS-3025 (the German doctors in Hamburg and Frankfurt are notorious for not handing over that piece of paper  ). They took their vaccination papers to the USCIS doctor and were able to get the vaccination supplement filled out anyway. You might have to call around a bit to find a doctor who will do it, but apart from that, it shoudln't be a problem.

Good luck,

CW

my husband and i were in the same situation!

while he was getting his medical done in ukraine and they asked for his paperwork from the doctor, he told them he had none because the doctor didn't send it to him in time. the people at the american clinic there told him,"oh, don't worry about it. on a k-1, you don't need to get it done to enter the country. you can get it done there." lovely, huh?

don't sweat it, though. we found a great doctor who was able to take his nontranslated paperwork from his doctor in ukraine and he was able to do it all for us.

if you wife has all her shots updated, then you should only be charged about 5 bucks for the paperwork. just call INS or go to the website for the nearest doctor near you who can do it. the rest will be up to them.

good luck!

Are all adjustment of status applicants required to have a medical examination?

Most applicants for adjustment of status are required to have a medical examination. The medical examination must be conducted by a civil surgeon who has been designated by the USCIS. The examination must be documented using Form I-693, Medical Examination of Aliens Seeking Adjustment of Status.

EXCEPTIONS:

2. Ks: If you were admitted to the United States as a fiance(e) (K-1), child of a fiance(e) (K-2), Spouse of a U.S. citizen (K-3), or child of K-3 (K-4), and received a medical examination prior to admission, then you do not require another medical examination as long as your application for adjustment of status (Form I-485) is filed within one year of your overseas medical examination. You will, however, be required to submit a vaccination supplement with our adjustment of status application. The vaccination supplement must be completed by a designated civil surgeon.

I would think they would take her vaccination records and that they would be valid. I had my DS-3025 but also took all my vaccination records (and Im going to tell you, they were not certified and they were still in the same lil’ yellow card my doctor wrote when I was a child). The civil surgeon appointed by the USCIS found amusing I had my records from childhood. They made copies of everything, filled my I-693 and only charged me 25$.

So, if I were you. I’d call the doctors in my area (from the list provided by USCIS), tell them what you have, ask how much it’d cost, and make your pick from there. Take all your paperwork to the doctor. It should not be a problem, and since you don’t need new vaccinations, it “shouldn’t” be too expensive.

Good luck!

I have the sealed I-693A.. thanks everyone! I had to call 4 places before someone would do it without a full phyiscal! I got tired of telling people she only needed the vac supplement, and then they still wanted to argue and one lady told me that we'd be denied and my wife could end up deported! :bonk::bonk:

We found a really nice doctor (on the civil surgeon list) who finally did it for $15. His nurse actually filled it all out from the translated records no questions asked. The DR signed and sealed it, and we were done in about 10 minutes. They we fully aware that K1s didn't need complete medicals, the nurse looked at her visa and said "K1, yep, pyhsical not needed"

Oh, there was one question.. when did she have chicken pox. They just asked for a month and year.... and to make something up close if we weren't sure!

Just waiting on our certified marriage certificate... tick tock tick tock...
