My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

There is no fee with sending in the 864 for the K3, you will actually submit the 134(AOS for non immigrant visas) at the time of your wife's interview.

Please do read the guides and also see here for some good info http://travel.state.gov/visa/visa_1750.html

Educate yourself in all aspects of this process and you will see that it will be much easier on you guys.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

If you are going to follow the CR1 visa path after the k3 approval, then yes..you will use the 864 and there is a fee due to NVC of 70.00.

If you are following the k3 path, then you will use the 134 and there is no fee....she would just bring it with her to the interview.
