Important questions before we send away our petition!

Hello, my fiancee and I are applying for our K1 visa, and I have a few question before we send it off. We

just want to make absolutely sure we did everything right!

First off, she'll be making one last trip to visit me in the states next week. However, we are trying

to decide if we should send out our papers before or after she comes. She can bring proof to the officer that she

intends to return with a letter form her employer and other bills, but I don't want her to be hassled even with such

proof if the officer has the info of a pending visa. The main reason we are thinking of sending it before, is because

it was signed last week and her passport photo was done 3 weeks ago (with no date on it, but do they even need a

date for it?) She has no intentions of staying in the states, we just want to visit one last time before the long wait

begins (as I am unable to visit her often).

So basically I'll set up my questions as so:

1) Does the passport photo NEED a date written on it? (since they always state having it sent within a month,

but I've only read that it needs to be put in a baggie with a name on it, not a date)

2) Is there an issue with sending away a paper if it was signed up to almsot 2 weeks ago when it gets

received?

3) Would it be an issue to send the papers away JUST before she leaves, so it gets there before she enters

the country and then I don't have to say that the papers were prepared when she was in the states? (since

she was not at the time)

4) How should the package be mailed out? Staples? Loose?

5) For those who have had their peitions accepted, how much proof (for photos and receipts etc) did you use?

6) Also, on the letter of intent, does a date need to be hand-written along with the signature or is a

typed-out date just fine?

I have not got my NOA2 yet, so I will defer to those who have the liberty to say 'do it this way, because I passed', if they contradict what I say below.

I'll just state (because you'll see/hear it a lot) read the guides. They will answer a lot of questions. Filling out your time-line or at least stating where your SO is from, so people who did their journey through those consulates/embassies can have better knowledge on what to do, as the embassies have different interpretations of the laws/policies.

For what I did:

1) I did not put any date on passport photos. I did put date on the photos of us together

2) Mail takes time. 2-3 weeks even if using 'express services' depending on the country, so 2-3 weeks previous date shouldn't be a problem.

3) Would it be an issue to send the papers away JUST before she leaves, so it gets there before she enters

the country and then I don't have to say that the papers were prepared when she was in the states? (since

she was not at the time)-I am trying to figure where you have to declare you filed while she was here or not....or what problems this will bring up. A lot of people who have visits will bring a copy of the K-1 (to show if they are asked), to show they are doing things legally and will not stay over time. Pros and Cons to this can be found in different threads.

4) They disassemble and reassemble anything you send in to fit their needs. I just bound everything together with a big ACCO clip.

5) Probably depends on consulate/embassy.

6) The signature is a statement that the above (including date) is correct.

get the trip in as good extra proof, get few more papers, pictures etc then send. Some papers (like fr Morocco) take 2-3 weeks just to get here so thats within reason to be a few weeks, you do use a small bag for the pictures, put names and dates on back of all pictures, use the large clips no staples im talking about the slide lock kind, punch a hole at the top use clip. Make a good cover sheet and like table of contents of divisions. The letters of intent are from both, dated and original signature for each. Depends alot on past history of your embassy as to how much, maybe ask someone that has been there. For us in Morocco we have to get alllllllllllllll information in the original filing others only have to do very simply but it sounds like your going in the right direction

Ok, sounds like we are on our way.... My last question is, we have put together all of our proof of being together and have:

event tickets for each of us

4 plane tickets

6 transport ticket

10 photos

receipts for a store

Think that would be enough (that is, anyone else have this amount or less and been accepted?) or would we be denied and need even MORE than that? Or... is it just too much?

Oh, also she is Canadian, if that makes a difference with the amount needed (since I know every country has different requirements).

I would quit sweating. Just include as much proof of relationship as possible. Evidence from her trip would be prime material to include, so I would wait until she is here to submit. The passport photos don't need to be dated, but dates and locations should be included with your other photos. Think of your evidence of relationship as a narrative. You are telling the story of your relationship. It makes it easier to think of it that way. You can even write your story, or have someone close to you, who has watched your relationship grow, write it up for you and have them sign it as an affidavit to be submitted.

1. NO. Just her name printed in pencil. Do not worry about it being within 30 days. Make lots of passport photos. We made about 15 to begine with and used the same photo throughout the process, as long as there is no major appearance changes

2. No.

3. No. Send it anytime

4. No staples. paper clip the assocaited items together and a binder clip on the whole thing. Anything else is not needed. The USCIS will disassemble anything you send and put in their own folder.

5. I sent ONE photo, passport stamps and boarding passes for the trip where we met

6. Typed, handwritten or any combination thereof as long as it is legible

Depending on your eventual consulate (which you don't identify), this could be underkill, or even fatal to her chances of being issued a K-1 visa. Take the advice of using this upcoming visit as EXTRA evidence for your filing.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You really need to let us know the consulate. As Tbonetx mentioned some are tough about the photos. I lived with me wife in Thailand for 2 years. My wife showed up with all kinds of evidence and 5 photos. They wanted more. Here is my review of that experience:

It took 3 tries to get the visa. She went in alone on Feb 23, 2009. They gave her 221g. They wanted more proof, and said that more I-864 was below the guidelines for 2007, since I owed the IRS 10k. I fixed the I-864 issue by sending my 2008 IRS returns with W-2s and 1099s which showed me to be well above the limit. I sill haven't figured out how they found about this, or why NVC didn't deny me at that stage. Went back in March 2 with the updated tax returns and more proof. The accepted the tax return, but denied her again. We want to see more photos! Ok then 2 digital cameras, photos together all over Bangkok, off to the 1 hour photo shop. Went back in AGAIN on March 3 with these photos. Visa approved, come back tomorrow to pick it up.

I lived with my wife in Bangkok for 2 years. I showed them utility bills with both our names, at the same address in Bangkok. I also showed them two passports with about 100 entry stamps into Thailand. I guess the issue was that I only proved to them that I lived in Thailand, not that I lived with her. So next time you are together, go crazy with the camera.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

One last question:

On the updated G-325a, where should our zip/postal code be listed under, address or country? I'm thinking under ``address``, but going along with how a letter is mailed, it's always right before the country, so would it be in the ``country`` spot, perhaps?
