Do I need a I-766 and K1 for a SS card?

Hello All,

My fiancee went to the local Social Security office with I-94 showing her K1 status. They refused her the issuance of the SSN card because: "K-1 spouse requited an I-766/I-688 as well for issuance of SSN card." Not sure I quite understand if one is really needed as the SSA-POM Section RM 00203.500 states: "The following sections list nonimigrants, by alien class of admission codes, who are authorized to work in the US without specific authorization from DHS. The person's I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD."

Do we need and I-766 or not?

Thanks,

Kenneth

Never heard of either of those two forms (I-688 nor I-766).

Is your wife's I-94 expired?

If you haven't already, check out the How To Get A Social Security Card Guide - pretty much outlines it there.

moved from K-1 forum as no longer a K-1 visa matter

Depends on how long she has been here. If less then 76 days, no she does not need an EAD card (I-Form I-766 or For I-688) BTW They no longer issued I-688 EAD cards.

If she has been her less than 76 days I would go back to the office (BTW which office was this?) and ask to speak with a manager and tell him or her to read POMS section RM 00203.500C1
