AOS for Step Daughter

I know there has to be somebody out there that has done an AOS for their wife and step child and I need your help. I filed for my wife and step daughter(who is 10 years old) at the same time but received the step daughters package back stating that the $600.00 filing fee was wrong????? The rejection notice states that the filing fee should have been $305.00 for the I-131 = Application for Travel Document. I an confused because everything I have read states that the fee is $600.00 when filing with a parent and the child is under 14 years of age so any help and advice on this is appreciated? What forms should I send back? What check amount?

The letter you received is incorrect. If the child is under 14 and files for AOS with the parent and the I-131 is included at the time of filing, there is no fee for the I-131. You will also have received a NOA1 (I-797C) for your wife and step-son. Re-submit the I-131 with a copy of the I-797C for your wife and step-son. I would also attach a letter explaining that the I-131 is being submittd concurrently with the AOS and even include a copy of their regulation if necessary. Sometimes you have to whack them between the eyes with a 2x4 to get them to pay attention.

I have done AOS for our two sons and did not have to pay extra for the I-131. One was under 14 at the time and I paid $600, the other is over 14 and the cost was $1010. There was no additional fee for the EAD or AP for any of them. I sent one check for $1610 when I filed for my wife and son (under 14) and one check for $1010 for the older son (K-2 to follow). No problems.
