Forgive me but this stuff is all quite confusing.

Ok, my mum married a US citizen 4-5 years ago and has been there ever since. I'm not 100% sure whether she has her green card or not... Anyway, I want to move over there but I'm not really sure on how it works... I know that if she does have her green card then I'm eligible (i'm 22 btw). What do I have to do to get my green card and how long does it take?

If my mum doesn't have her green card how long would it take her to get it? Like I said before, she married a US citizen 4-5 years ago in the states and is still married and living over there.

  • You Married? (If so, all bets are off on your Mum petitioning for you.)
  • Otherwise it would take YEARS for you..

What if I came in on a tourist visa and found an employer that would sponsor me, would I have to come back to New Zealand or would I be able to wait in the states till I got a working visa?

A Visa is used to enter the US - meaning you get a Visa before you enter (not after) - otherwise using a tourist visa to circumvent immigration laws is visa fraud.

It's almost impossible to get a work visa this way. Usually a US employer has to have a need that cannot be filled by a US resident and the employer applies for an employment visa for a particular talent; engineer, scientist, etc. The number of visas are very limited and run out very quickly. The people coming in are highly skilled.

The US does not allow foreign tourists to come in and compete for jobs with their residents. It makes sense that the US only allow in workers that cannot be found domestically and who can build up the US economy.

So the premise that you can come to the US and find an employer that can sponsor you is not realistic.

Considering how long your mom has been married, assuming she is here legally (ie has her green card), she has apply for citizenship. Once she is a citizen, it will be much quicker for you to gain a greencard through her.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

in USA, that is considered fraud

Even if his mother is a citizen it is still going to take about 6 years for a visa to become available. He/She would be in category F1 and they are now issueing visa's to people who have a priority date of 15 May 2003, if you are from Mexico the priority date is 1991 and the Philippines is 1993.
