there may be a chance that my fiancee and i screwed up and took too long to answer to our noa2 due to monetary problems.

i wont know if our case is closed until monday and i am distraught at the thought that we may be denied for being a few weeks late in getting in touch with the consulate. we had no idea there was a 4 month validity period.

please advise...

if my fiancee were to come here and we got married, could he stay here with me while we file a k3? i could get him on my lease and we have more than enough proof that we have a legitimate relationship. we just don't want to be apart anymore.

DONE WITH USCIS FOR 2 YEARS!

i personally do not know if u will be denied or it will show case abandoned but i do know that if he comes here with the intent to marry and stay its called visa fraud.

i hope ur case is still active4 if not u will have to file some sort of marraige visa again

You will have to address/withdraw the K1 petition that you have already filed before filing anything else. Just letting it sit prevents you from submitting any other petition.

As he is in the system assosciated with a K1 the CBP may ask for more proof of ties to home.

None of us want to be apart from our loved ones. Playing the sympathy card won't get you anywhere with USCIS or the CBP.

Before you worry about alternate plans contact the consulate and get some answers from them regarding your K1 petition.

You will have to address/withdraw the K1 petition that you have already filed before filing anything else. Just letting it sit prevents you from submitting any other petition.

As he is in the system assosciated with a K1 the CBP may ask for more proof of ties to home.

None of us want to be apart from our loved ones. Playing the sympathy card won't get you anywhere with USCIS or the CBP.

Before you worry about alternate plans contact the consulate and get some answers from them regarding your K1 petition.

i would never do anything to violate the system. i'm hoping we WONT have to go the k3 route because we were almost home in regards to the k1. we were going to get him the medical on august 17th, and then...

the last time anything got filed was in april when i did the online ds-130. the time just got away from me and i wasnt aware of the 4 month validity. i feel so stupid and so sick about this. i did everything else right. we were so orangized and i'm just so worried about the conversation with the consulate on monday. i hope they see that this case is certainly NOT abandoned...at least on our end. we just had money difficulty and needed more time. had i known, i wouldve absolutely asked for an extension.

i guess now i'm just looking into other options if we are indeed denied (god forbid)

most consulates will auto renew your petition depending on circustance.

Our k3 got stuck in AP at NVC and I was worried that it would expire before it reached the consulate. I emailed and they said the above.

Just email them and ask if its still valid.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Did you email the Consulate? It's possible they may have extended your validity date on their own. I don't know that you would be "denied". They will advise you, but it may be that your case will be considered "abandoned". If that is the case, you'll want to reapply and pursue a CR-1, not a K-3. You'll need to get married for this first, and then with your marriage certificate, make application. He'll be able to visit you in the interim, the same as if he'd been with a K-1, but right now a CR-1 is taking about 8 months I think in Canada, so he couldn't live with you for 8 months before returning for an interview, but could for awhile. Please let us know what you find out from the Consulate!

the consulate wrote to me today and told us to just move our asses with the paperwork (i am taking liberties with their words, of course)! i forgot that we had damage to the first checklist they sent us originally and sent us another in march! so our paperwork was still within the 4 month period BARELY.

i'm sure you can imagine the relief! we were just so close to the end we didn't want to even consider another option. lots of praying from family and friends went on and i know that made all the difference :)

thank you again for the concern. you cant imagine how it is appreciated!!! :star:

Did you email the Consulate? It's possible they may have extended your validity date on their own. I don't know that you would be "denied". They will advise you, but it may be that your case will be considered "abandoned". If that is the case, you'll want to reapply and pursue a CR-1, not a K-3. You'll need to get married for this first, and then with your marriage certificate, make application. He'll be able to visit you in the interim, the same as if he'd been with a K-1, but right now a CR-1 is taking about 8 months I think in Canada, so he couldn't live with you for 8 months before returning for an interview, but could for awhile.
