My wife came here as a K-1 and brought with her 2 girls as K-2's. I understand that she qualifies for a 3-year reduction on a citizenship application, i.e. 3 years from conditional GC instead of 5 years. But what about the kids? Do I apply for them using the 3-year rule as well, or do they need to wait for 2 more years? They will be 8 and 17 at the 3-year mark.

Any info would be appreciated.

Thanks!!!

Hopefully, won't be any delays and your 17 year old will be still under 18 or that 18 year old will have to wait five years. Our plan for this was screwed up by delays with the USCIS, so another two years for her, three more long trips to the field office, and another 670 bucks if they don't increase the fees again. But if they stay under 18, you will be fine. Not sure if you are done with the AOS, and the I-751 yet, step daughter was delayed with the AOS.

Did wonder what would happen if your marriage didn't work out, but your step kids still wanted to live with you, guess they are screwed, while their AOS is completely independent, have to lay out a fortune for all those form fees, their applications are totally depended on your spouses status. You only have to pay 80 bucks extra for each kid for the biometrics, but they get a free ride with the I-751 and N-400 application fees, they do have to attend the oath ceremony. Provided they haven't turned 18 yet.

Thanks for the response. I am not sure why a delay with the I-751 would be pertinent, as the 3 years count from the "conditional" date, not from the "clear" date. Unless you were talking about a delay at the "conditional" stage, in which case we were fine.

Thanks again!

Same rules and conditions apply to K-2s.
