Filing I-130 from abroad

Ok, so it's looking like we're about to abandon the K-1 in order for me to go move to England and then I'll live there with him while we wait on a CR-1 for him to move back over with me.

Thing is, you have to have lived in the UK for I think 2 years before you can do a DCF, so that's not an option for us, but I'll be living there so I wont have a physical address in the states.

Will I need to have an address in the States to file this the normal way? If so, would a relative's address work? I could have stuff sent to my Dad, and then he could send me anything from USCIS, and I could send it back from over there.

I'm a little confused by all of this, and the guides only mention DCF if you're living abroad with your spouse. (we're getting married once I get there).

I am not positive but I think you need a US addy and possibly a relative may be ok. Maybe someone else knows this 100%

I lived out of the country for 7 years but maintained a place of residence, my Dad's house. I kept my american driver's license addressed there, I voted with that as my place of residence (absentee voting,) and kept a credit card in my name at that address. If I was in the US, that was where I stayed. I don't know if that is all legal, but it is what I did.

Now that I am back, I'm really glad I did that, 'cause I'm still at my Dad's house until my spouse can join me here. :blush:

Hey pja002!

I'm just trying to get an idea of when we should be recieving our NOA1.

We are filing CR-1/IR-1 abroard same as my USC came here to file DCF just before the change occured. So we have filed our I-130 at Nebraska but haven't heard anything yet nor has the cheque cleared and it's going on to our third week.

Is this the norm? I see by your timeline that your is similar.....any thoughts on this?

We've been using my wife's parent's address as the mailing one for all the US documents - and she is still registered as living there - it's all worked out fine so far.

Married to my USC Spouse in the UK 08/17/2006

Entered the US with my CR1 on 09/25/2007

Mailed I-751 application on 07/14/2009 to CSC

I-751 package arrived at CSC on 07/16/2009

Check cashed on 07/20/2009

NOA1 Dated 07/16/2009

Biometrics Appointment 08/21/2009

Touched 08/24/2009

APPROVED 09/14/2009

Card Production Ordered 09/22/2009

Card arrived in the mail 09/28/2009

US Citizen as of 10/20/2010!
