Hi everyone. Ok, so about 2 weeks we received NOA2 for both I-130 and I-129. My wife (currently in Russia as I am in the US) emailed the NVC with our case number to request me to be her agent. Just yesterday she received the email response saying they accept the terms of her assigning me as her agent. Then today, in the postal mail, she got a packet that has documents and that she is to interview for her K3 visa on August 17 at 8am in Moscow.

Here's the deal -- neither one of us wanted the K3 visa, we wanted to wait for the K1 visa. So what should I do? Do I need to call the NVC and tell them we want to pursue the K1 visa only? Or do we simply ignore the interview appointment for the K3? I am assuming we have to call someone, yes? Did our I-130 status get cancelled?

You mean... You want to pursue the I-130 CR1 (immigrant Visa) the K1 is a fiancee visa. You might want to call the embassy and reschedule the K3 interview for Sept. and then finish the NVC process for the CR1. Once that is completed request the K3 interview date be converted to the CR1. At least this way both petitions remain viable. I think I read somewhere here about cancelling the K3 could cause an issue with the CR1... I am sure others will chime in on this for you.

I figure best to keep all options open.

they are two separate visas.. one has no effect on the other... you choose the visa path you want and pursue it... it would be courteous to contact the embassy and inform them that the K-3 is not desired and you are going to apply for the immigrant visa... they will understand.

FWIW, interview "conversion" is not available in all consulates...

You mention contact the us embassy in moscow -- but couldn't I contact the NVC instead by email and let them know? They give a phone number in Moscow on the documents she received, but it's some sort of helpline that charges $5 per minute and I will be billed for 12 minutes minimum -- that's a ridiculous price to pay just to cancel. It seems to me that it's not based on courtesy, but rather robbery at this point. It says this is the only way to contact them too.

Let's say she doesn't contact them and just doesn't show up, will it *hurt* her chances for the CR-1? Because again, that's what we wanted to begin with -- the I-130 interview, not the I-129. I don't want to cause problems -- but if I can merely email the NVC and let them know, then I'd rather do that instead of paying $60 to cancel the k-3

interview appointment.

Have you paid the fees for the I-130 to NVC yet? About $470 tatal?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Unfortunately NVC has nothing to do with the K-3 appointments. They are scheduled by the embassies and NVC knows nothing about them.

And it's not a 12 minute minimum to call- it's a $12 flat charge. I wouldn't rely on any information received from a hotline though. Always best to put it in writing and receive a written response.

The DOS has this page: http://travel.state.gov/pdf/medical/MOS-ME...L-0001-0903.pdf which also provides an email address and a street address. I'd suggest sending them an email as well as a written letter stating that you'd like to cancel the interview.

Thanks for the link. This is exactly what my wife got but it's written in Russian, therefore she got lost in translation when reading it to me over the phone. $12 is a lot more reasonable. I suppose I will email them first -- it's not until August, so we have time still. If I don't hear anything back, then I will call them the week before and cancel it.

I haven't paid the $400+ fees yet -- was planning on paying that next week, but wanted to make sure everything was ok thus far since all this stuff happened over weekend. :)

I believe you will have to write a letter requesting that the interview be canceled and why. Then you will have to scan the letter that you have signed and your passport. Both will have to be sent as an email attachment to the consulate.
