I am so sorry to hear about the denial. Be calm and rational, It is hard to say what is in the minds or the intentions of others in power, but Take charge of the situation;

1st, have your finace write down exactly what happend and questions/responses while it is still fresh in his mind

2nd, Gather as much supporting information as you can

3rd, Most senators or congressman have a section for dealing with Federal Agency intervention and have a form you can fill out and have to sign (privacy act)

4th, Keep on top of where your application is being sent and when it arrives back at USCIS so you can take appropriate actions and know where your file is

Finally, there is a useful thread which discusses common questions and things every couple should be able to answer without hesitation, I would look it up and review it with your Fiance. Everyone gets nervous, but this is not the end of the road...

If your motivations are genuine, you will have other opportunities to prove that and live together happily, it just might take longer, that's all, not the end of the road, just a bump... Keep your head up.

USCIS has obviously examined your case closely and has considered all of your supporting documentation in detail. They made an informed decision.

Don't therefore be offended of people on this board assume that the government was correct in deciding that you became married solely for immigration purposes.

I cannot offer you any sympathy because I have not seen your case. USCIS has.

And Nigeria is deemed a "high risk" country when it comes to immigration applications. This is a fact. It is not offensive to point this out.

USCIS did make an informed decision(solely based on documentation being in order)...they approved their petition. The consulate is who decided to send the petition back to the US. btw- the consul does not even have the authority to deny a case, they can send it back to the USCIS and recomend it be denied. If you are going to post with such certainty please have your facts straight as not to put out misinformation for furture readers AND not to harm or misinform any OP's.

Nigeriaorbust had some great suggestions and questions.. have him write everything down so you know exactly what went down during the interview. also, if there was an incorrect form, they would just issue a 221g and ask him to return the correct forms with any other required docs.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Jusbola22, I could understand how you feel now. Our case was odd and somehow similar to yours. Our petition was sent back to USCIS and my fiancé didn't receive their notice of denial, not a letter. And for me, I even wasn't contacted by US Consulate for an interview (they sent it back without giving me a chance for interview). Just my fiancé heard of the issue "petition sent back to USCIS" through the mouth of an immigration representative at a court where he filed to. So today we've joined this forum with a hope to hear from VJ people' advices on our case. My fiancé will post our case to here soon.

For your case, you'll have to wait until receiving the notice of denial from USCIS. You may want to file an appeal. Then you should access this link to see how-to.

I was denied after a 3.5 year wait - no interview, no denial letter, and no reason given. When I received my application file under the FOIA, more than 35 pages were blacked out and Congresswoman Sheila Jackson Lee told me that ultimately, the government has no obligation to tell you anything they don't want to.

Hello,

I understand the grief you are experiencing. Just want you to know that I have dealt with the same thing. I attempted the appeal but then our petition was withdrawn. We are now filing a new petition. My advice would be to find a good attorney and definitely visit your husband and compile as much evidence as you possibly can. Do not be discouraged. This will pass.
