reason for denial

Timeline

Hi everyone, my husband sent me the denial slip, and it stated that our marriage was for immigration purposes only. I dont understand where they got that from, i am just still so upset, the guy that interviewed my husband didnt even give him a specific reason, he was just picking things out of no where and then he said we cannot issue you your visa at this time. I called the senator and he said that there is nothing they could do until it comes back to the states, and that we would probably have to re apply. I called a lawyer and they didnt return my call today, i emailed the embassy, they havent emailed me back yet, i dont know what to do next!!!

Until the file arrives at USCIS, there is nothing anyone can do. The CO's decision cannot be appealed. USCIS will give you a chance to present better evidence of a bona fide marriage and that's when a lawyer can help. It will take a few months before you have the chance to resubmit with better evidence -- maybe more visits to your husband would help.

Nigeria is overflowing with scam artists and that's part of the problem.

i watch the dateline show and it says the same thing about nigeria is overflowing with scam artists.

i have nothing against nigeria but it was on the national tv show

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

please everyone stop all this talk about scam artist, my husband has just been denied, to be with me, i dont like to read about this, all nigerians are not scam artist, if you really want to get technical, there are scam artist all over the world, just so happens that the spotlight is on nigeria right now, but what about the scam artist in the us, and all over the world, please stop my heart is hurting right now and all you want to talk about is scam artist, im just trying to figure out what do me and my husband do next.

u can just talk to good attorney who does these kind of cases with sucess

wait till u get ur case back to USCIS and then take it from there

Without knowing all the particulars about your relationship with your husband it's tough to speculate as to the reasons.

Did you receive any RFE's throughout the process? As best you can look at your case / your story to determine where the CO saw weakness or lack of evidence. This will help you to prepare for getting this turned around.

Sometimes the interviewee is really nervous and answers questions inconsistently. If your husband didn't know the "typical information" about you as a spouse this may have caused the CO to have doubts.

In our case Vietnam is also one of the high fraud consulates (considered one notch below Lagos) and thus anyone going through there is wise to overprepare their submissions. Also, in general multiple visits to Vietnam is seen as a plus. As well as following the traditional cultural norms regarding engagement and/or marriage. If you were thin on evidence that could have also raised doubts.

You've got to give yourselves time to calm down after this tough news and then get to work addressing the areas where you believe your case can be made stronger.

Call your other senator. Mine helped me when the petition was still at the embassy. Once the petition is back at USCIS that's when they can't do anything much.

Sounds like the senator you contacted doesn't have a sharp "immuigration specialist". Mine has a KILLETR specialist that has help me and others numerous times with success most of the time.

Agreed that the senator cant do anything once its reached the USCIS. He/she CAN however request that the consulate holds on to the file and give you a chance to submit more evidence or re interview.

Try your congressman since your senator sounds like he doesnt know much about the process.

Ahn map pointed out that when you are dealing with what is considered a high fraud consul, you need to be prepared more so than others.

Do try to breath and calm down and ask your husband exactly what was said and how he answered the questions. You can examine that and see if there is anything that you need to address in particular.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Try and get a copy of the denial to see if there is an appeal process. Sometimes they allow an appeal. Do everything that you can to keep your application at the embassy. Call your senator back and tell/ask him to contact them and keep it there until you find out exactly why and if there is an appeal that you can file.

Just like I see online everyday about filipina scammers and ladies who go online begging money off men! In all that, when pinay women come on here for help, that is not the stupid response they get to their problems! As much as you watch it on dateline, not all Nigerians are into scams...noob! As for the OP, try contacting another senator but you also need to go through the questions with your husband and see where he went wrong. I can tell you for a fact that those CO's at the embassy return the cases for no just cause, just a hunch can make the power-drunk CO's return them without regards for the pain they are inflicting on the families. Our was returned and reaffirmed without USCIS asking for more info, we now really want to know the stupid reason why it was returned and will be filling a FOI on the case soon. All the best.

The samething happen to me with a fiance petition. As soon as my case got back to the USCIS it was approved, but by that time I had went to my then fiance and got married. I just want the other person know that you may be delayed but you won't be completely denied. Just trust that GOD will get you though this one, and this to shall pass.

Justbola, Like the others have said, try and get your other sentaor or congressman to ensure the case stays in Lagos and you are allowed to submit additional evidence showing your marriage is bonafide and not for immigration purposes. I pray all turns out well for you and your hubby.

Jusbola22: Im not to where you are yet however I have read all over VJ how you should contact your senator/ congressman to get the petition to stay at the embassy. Just as another suggested, if your good for nothing senator's office could not help try the congressman's office. You are in my prayers sweety. (F)
