Hello Everyone!

I was a K1 holder before and it was not materialize.

My ex fian ce was here in the Philippines. He told me he will look for some piece of land here.

Likewise visit some of his friends and even meet the lady that was been involve our separation.

My question can he file a new K1 for the new lady? We were just separated for 2 months.

How fast it will be and if they have some emails exchange while we are together. Does it will have give problem to the USCIS? And what will be the percentage that the new k1 will be approve?

Correct me if am wrong but the truth is YES he can,,provided he is able to meet all the requirements.USCIS does'nt care who the petitioner is and how many he is corresponding with at the same time.

No issues, he can petition for another as he see fits. (he would need to list his previous K-1).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Forgive me, but why do you care? You have separated...what he does with someone else is truly not your business.

As far as procedurally, yes he can file another K-1 petition. The length of time he's been separated from you will not be an issue to get the petition approved with USCIS. It may, however, become something needing justification when the new beneficiary has her interview at the consulate. The underlying condition that must be met to get a K-1 petition approved is that both parties be free to marry...your ex was not married to you, and if his new lady is also not married, they both meet this condition. That there was a time period during the budding romance in which he was still engaged to someone else is a gray area that would need justification, but is not something that should preclude the beneficiary from receiving a visa. C'est la vie...

DEC 2004 Approved

interview: SEOUL

MArch 21st , 2005AR for special security clearance,washington

May 18th tranfer case from Seoul to Islammabad

June 21st security clearance done

June 28th online at the embassy in Islamabad

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

hello, im very sorry to hear about ur story...i know how it really hurts esp that u've been here and then need to be back there bcoz of ......, but ur still young, he is not d one for you and I know that in d right time and right place, ul find someone better than him. Forget about him and be happy. Remember that the greatest gift of God comes wrapped in pain. GodLuck sis and il pray for you.

I would think if he is filing for someone else or thinking about it he would also no longer be your fiance NO?? Move on dear light will shine on you but also remember Karma.............

The best thing you can do is to move on....find someone else who will truly value you.
