VAWA INTERVIEW!!! PLS HELPP

Actually someone answered about this the other day on another thread and attached a link to the official immigration notes on it. As a VAWA case it is still only 3 years from first obtaining a GC.

can you please tell me which tread that it is answered in or can you copy and paste the link here so I can review it. I was not able to find it when I searched for it.

There you go. I looked up the section too because the memo is 8 years old (right now) and found it's still current.

I know this memo, it says that you can apply citizenship after 3 years but the original question is can you apply citizenship after 3 years even if you re-marry to someone else? I know it for sure that you can apply citizenship after 2 years 9 months but i am not sure if it is still the case if you get married again. Please forgive me if i am over looking to this memo but i dont think it says anything relate to the question. By the way thank you so much for your qucik response!

Well re-marriage is irrelevant really. Why would your new marriage impact your citizenship? It doesn't. There won't be a memo on it because it's irrelevant. To the US government what IS relevant is what your ELIGIBILITY criteria is, so lets go through that:

1. Were you married to a USC and that's how your got your GC? AND

2. Are you still married to the USC that helped you get your GC?? OR

3. If not still married to USC that helped get GC, did you get your GC based on VAWA?

If yes to 1, and yes to either 2 or 3 then you're fine to get USC after 3 years of LPR (well minus 90 days). No issue. Whether you remarried or not doesn't matter to your eligibility requirements. Just like having a child, buying a pet cat, or buying a house is irrelevant.

I actually won't be surprise if such a thing affect the citizenship wait time. Based on the research I have done, there some people say yes it does and some people say no it does not. That is the reason why I am trying to find something in writting. And actually, immigration does really look for reasonableness, most of the time they have certain set rules and if you fit in that you are fine if you do not then you are not.

When I think about it I come up with the same answer as yours why would they care and I hope you are correct on this!

By the way I got my GC through VAWA, and if you are in the process of receiving yours, I wish you good luck!
