What do you mean, Moniq? The cancelling part? I don't know. We called when after a good 25 days our check hadn't been cashed and we had received no notice on the NOA1. They told us that we had filed incorrectly and therefore, they had cancelled our I130 petition. That it should have been filed in Detroit and not Chicago because my husband is from MI. We freaked out for about an hour and then we realized that we had filed correctly. After my husband ripped them a new one, they admitted it was their fault and got cracking on the NOA1 immediately. Our check was cashed the very nexy morning and we had our NOA1 in the mail in two days. Apparently his "Is this how you treat American citizens who have put their lives on hold for you" spiel sent them scurrying into action. I wish they would approve the NOA2 with the same amount of speed.

Wow. That is terrible that you got deleayed by thier error. Hopefully now that it ha been sorted out the rest will be a breeze. :thumbs:

Wow!!!, I am really sorry. Yes, I think we all can agree that our lives are put on hold. I am not sure how religious you are, but praying has really helped me get through alot.

Hello all,

After reading this HUGE forum for weeks(head is spinning) now i finally gonna post my story...

I met my hubby (us citizen)(1994)on a mozilla/firefox googlebar chat called chatzilla,he came and visit me twice that year and on 10 jan `05 we flew together to LA(me on toerist visa) on 4 febr`05 we got married ,money was running out and he could not find a job in LA,got a job hauling some jet ski`s to NJ (he is from NJ) but the car did not brought us further then Kingman,AZ,at that point we where really down to the ground ,eventually he worked his butt of to get his CDL(was the only way to get out of there),after a few little companies that he worked for OTR (over the road),i drove with him on his last job out of Las Vegas,then in june `06 his mother died,he had to quite his job to deal with the tragic news,it still took as 6 weeks before we arrived in NY.

After that he had inherited some money(`07), we hired a lawyer,this progress took along time ,

in the mean time we moved to to NJ to find/get a driving job(local),there was`t any so he took a job OTR (end april `09) and i would join him a month later....but here it comes ....

Over the years i had regular contact with my family(Holland)true msn cam and email,last year my mom got a scootmobiel because she hardly can walk anymore,my thoughts where in may `09 so flipping that i needed to see my family before i jump in the truck,my imagination was like ok once i step in the truck the whole progress of adjusting my status was gonna be reduced to 0,what if my mom died and i have not seen her since i left Holland,so i went to the NY embassy to get a temporary passport,(since my old passport was not valid anymore)they took out the green I-94 that was still in the passport.On may 6 `09 i flew to Holland(i dint tell my hubby)I know I know that was quite stupid of me but i thought i just could fly back within a week or 2,but when i did the ESTA i was denied.

The lawyer have send in the papers after i had signed it and had send it back to him that was on 2009/07/15, NOA1 2009/07/23 still waiting for NOA2

Now i have read allot about cases where people where removed/deported that they have to file for a waiver eighter a 601 or a 212

I dunno if we need any of those 2,is there any change that we will get approved without the need of a waiver?

Any suggestion is welcome

I don't think that will affect you at the current stage (USCIS) but it may be an issue once you get to the CO stage(Embassy) but don't feel bad I have been waiting for NOA2 as well I filed in August :blink:

INTERVIEW DATE: 02/17/10!!! DENIED FOR NO APPARENT REASON.. :'(
