Hi guys!

I am a little bit puzzled here. We just send our papers to the INS for my husband's adjustment of status and employment authorization. I received a letter from USCIS saying that we need to provide certain documents that we already sent... like my employment letter and form I-864 along with most recent tax transcript etc. My problem is that Friday was my last day at my job and I am scheduled to start a new employment in late August. The employment letter that was previously sent to USCIS is dated MAY. I just don't know what to do since I am not sure that my previous employer will give me an employment letter since I am no longer employed with them. I don't know what to do OR even why USCIS is asking for another letter. Please help me. :(

Resend a co;py of the same employment letter since it was valid when you applied. It may be that they have lost the original one you sent in. It sounds like all of the financial documents need to be re-submitted. Certainly your most recent income tax isn't going to change. Do you have a copy of your job offer for the August job? Can you get a letter of agreement saying you are starting employment on such and such date for such and such salary? If so, you might want to include that one along with the copy of the current employment letter from May. Good luck

Thank you for replying. I was thinking about writing to explain to USCIS what happened. I also called my former employer to ask if they will be able to give me another letter since Friday July 7 was my last day of employment there and I am still part of the union. I don't know if that will help. Gosh, I am so scared.

I thought they made changes to the I-864 so all you have to provide now is the most recent tax return. There was a link on the board somewhere that you no longer have to submit letters from employers, pay stubs, bank statements, etc. I guess if you are getting asked for them then this is false.

Let me just type what I see in the RFE.

"Evidence of current employment or self-employment including a letter from each employeron business stationery, showing date of employment, type of work performed, number of hours worked per week, and salary or wages paid. If you are self-employed, submit a recently dated letter on business leterhead or a business license."

They're also asking me for my recent tax return which I sent them, but not the tax transcript. I called IRS and ordered my tax transcript for the year 2005. I don't know what they mean by CERTIFIED copies of my tax return though. I think I will follow Kathryn's advice and send them the letter I obtained in May from my previous employer, but they are asking for a RECENT one, HOW RECENT IS RECENT to USCIS?

send all of your docs overnght with receipt requested...keep your receipt of this transaction as well as the payment receipt from your post office...if something like this happens, simply send again all of the docs along with copies of the receipt and payment receipt.......uscis loses docs far to often, and this will cover you...it did for me...good luck

If they want a certified copy then go and get your tax return notarized and then send that in. I would just send in a copy of the original employment letter again as skinsfan suggested.

You are probably referring to the fact that you now have to submit only the last year's tax return, not the last three years' (which is still stated on the actual I-864 application). It is not true that you no longer have to submit employment letters, etc.

The thing I was taling about is that if you are approved on or after July 21st 2006 you no longer need to provide that information regardless of when you applied. Here is the quote:

"Each sponsor is now required to submit as initial evidence only his or her single most recent tax return rather than tax returns from the three most recent federal tax returns, pay stubs covering the most recent six months, and an employer letter"

However, if they are writing and asking for that information then I would send it to them. I'm just surprised since I read that press release that they are asking for it. I could be misunderstanding the new rules too....

All right you guys, I managed to call USCIS National Customer Service between yesterday and today, I got different answers on what to do regarding the request for additional evidence.

When I called yesterday that person told me that it is ok to just resend the letter from my previous employer, but that I should include a letter explaining that I am no longer working for them.

I called today, a different person told me that I should write a letter explaining that I am no longer working for my previous employer and that I am unable to submit the requested evidence because of that. Re-sending the same employment letter would be providing false information to USCIS and there are penalties for that. SHE also added that if I could get my prospective employer to give me a job offer letter just send them in.

I am more confused now. Since they are also asking me for the I-1864 again, does that mean that I can't provide it because I no longer work for the same employer? As I can notice, all the information on there is about my employment. I will submit the tax transcript for the most recent year obtained from IRS. Will that be enough?

I haven't been able to sleep all night thinking about this immigration process. I just can't sleep - I am scared, I feel like being haunted. I am just tired of all this.

Any ideas anyone?
