Rejection Notices Received, How to Resubmit?

So, I received rejection notice on the 485, 130 and 765. The rejection notice on the 485 says:

The check amount is incorrect or has not been provided. The correct filing fee is $930.00. Each applicant between the ages of 14 and 79 must also include an additional $80.00 fingerprint fee. Please resubmit the application with the appropriate fees to the address listed on the bottom of this notice.

Stapled to the rejection notice is the check I mailed with the 485 in the amount of $1,010.00 and on the memo line it says 485 + fee.

I thought we could mail the 80 and the 930 together... do they want me to mail two separate checks for the 485?

Now, I did make a mistake, I sent a check for 340 instead of 355 because I got mixed up between the amount for the 130 and the amount for the 765 and which one was which (as the 765 was waived because of concurrent filing). That one I understand.

They have stapled all the forms together in a sort of order. Do I just write new checks. One for 355. One for 930. One for 80 and stick it all back in the mail the way they sent it to me... or should I take them all apart and resort them and put them back in individual envelopes the way they were when I initially sent the package to them?

Attach a check made out to Department of Homeland Security for 355 to the i-130 and one made out similarly for 1010 to the i-485. That should take care of it. All the best!

You only need to correct the check for the I-130, The reason they sent back the I-485 is because if you are filing the I-485 along with the I-130 and there is a error with the I-130 they cannot accept the I-485. They must have the I-130 and the I-485 together.

You need to include:-

I-130 - $355.00

I-485 - $1010.00 (this fee includes Biometrics, Employment Authorization & Advanced Parole)

Two checks, each one attached to the correct application.

I had the exact same issue. I sent them 3 checks back instead of 2 and had a NOA 1 within a week. There seems to be no consistency at all with regard to sending one check for $1010 or splitting the fee into 2 checks for the I 485 :bangshead:

All I can tell you is that splitting it and returning it that way worked for me.

Excellent, thank you guys and gals, as always an excellent resource for those of us going through the process.

I'll just do three new checks: 355, 930 and 80 and attach them to the rejection notices and just mail it back to them as it is.

You do not need 3 checks... you need 2 checks 1. $1010.00 for the AOS + Biometrics 2. $355.00 for the I-130

Read the instructions that come with the I-485, they tell you that you can send one check for AOS.

Read my post above Tay. It may SAY that but I did exactly that and got it back requesting I split the checks into 3 $355 $930 and & $80. They were then accepted when I did so. So it seems to depend who deals with it as to which way they will accept. It would seem to be playing it safe to send three checks in the first place. I have not yet heard of anyone getting them sent back in that case. Unless of course another member cares to share a different experience with us?

Well as 99.9% of applicants sent 2 checks and have no problems, I do not see the need to send 3 checks. The reason the the OP's applications were returned was not because the I-485 had the Bio fee included it was because they sent a check for the I-130 that was not the right amount.

As the I-485 was based on the I-130 they had to return both application as they can not accept the I-485 without the I-130.

Thank you for pointing out that the 3 checks worked for you. I am sure that if the OP wishes to send 3 checks then they will do so. I on the other hand do not wish for others reading this to think that they must send 3 checks when it is not the case.

Two checks, should be fine, if correct fees are paid.

For I-130 petition: $355

For I-485 form and biometrics: $1010.

We sent two separate checks that were cashed just fine.

Per USCIS instructions, there is no need to split the fees for I-485 and biometrics.

"You may submit one check or money order for both the application and biometric fees, for a total of $1010.

However, I've read a few posts with claims that their applications were rejected because of sending two checks - one for $355 and the second for $1010. I personally don't buy it, unless their applications were handled by unprofessional USCIS officer who did not following official USCIS instructions that I quoted above. Another reason could be that applicants themselves might have sent wrong fee amounts or their submission was missing some substantial forms and/or supporting documents.

07/22/09: Checks cashed

07/23/09: Rec'd receipt NOAs (RD: 07/17/09, ND: 07/21/09)

07/27/09: Rec'd FP appointment

08/01/09: Rec'd RFE (I-485): I-94 or copy of visa

08/03/09: Sent RFE

08/06/09: USCIS rec'd RFE

08/13/09: FP done

09/03/09: EAD card production ordered

09/14/09: Rec'd EAD card

09/22/09: Interview: Approved

09/25/09: Rec'd I-130 Approval Notice & I-485 Welcome to USA Notice

10/02/09: Received GC in the mail.
