We got our RFE paperwork today and it is for the I864 and I now need to speak to someone about it, as we DO meet the requirements!!!

So I called the bloody USCIS number and held for 25 mins, then I was put to someone about the Affadavit, he said I needed to speak to an immigration officer and he put me to hold on another line for 30 mins. I finally got an answer and the 'foreign' (how ironic) guy on the phone said my voice was breaking up and he could not hear me, I said I was on a landline, he said he could not understand me & HUNG UP ON ME!!!!!

I am so p#ssed off right now and back holding on the first line again!! And all this because it looks like they have made a mistake :ranting:

Sorry to hear that. If you live near a local USCIS office, you may want to try INFOPASS. At least you'll speak to someone (supposedly) qualified, and you can also ask to speak to the supervisor, if you are not satisfied with the answers.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

I share your pain by the way. I called the 800 number today as well. I was waiting for 10 minutes with that damn music when all of a sudden the phone went silent. I assume someone picked up and hung up. I know it wasn't the hour wait that you had when you got hung up on, but it was still annoying enough!! After trying to call back and being on hold for a customer service person and then on hold for an officer, and then on hold during talking to the officer, I still spent an hour and a half on the phone. *sigh*

January 10, 2003: K1 NOA

November 10, 2005: AOS approved w/o interview (749 days!!)

September 30, 2009: German Beibehaltungsgenehmigung

February 9, 2010: Naturalization interview and Oath Ceremony!

Well I have gone past the initial person agaon, and the Affadavit person - I am now 2 minutes back into the 30 minute wait for an immigration officer (hoping for someone who understands English this time!!!). At least the steam has stopped coming out of my ears now :hehe:

That's a good idea Anastasia but the problem is we are 3 hours away from the nearest office, so I will at least try this way first!

What makes me so mad is this looks like an error on their part. Seeing as I have time to explain whilst I hold (!!!!) - my hubby is self-employed, last year he had a big tax depreciation on his business. This took us just under the poverty level required. So we submitted the previous 2 years tax returns demonstrating his usual income, put in a totally separate letter also explaining why with just the tax depreciation page from his return. But then we also listed assets in excess of $100k. Remember on the I-864 it says if you are short but can give assets equal to 4 x the difference you are ok. Well we are WAY over the 4x in assets. So why the RFE!!!

His current taxes for 2005 are being done now, but we are just so p#ssed that they do not stick to their own rules on this, we are calling to try to politely find out why.

Plus, what the heck are they talking about, an RFE before your case gets to an officer? I thought the NBC was NOT to make this type of determination.

Well I finally spoke to an asian sounding Immigration Officer after 2 hous holding and the conversation went much like this:

Me - In 2004 he had a large tax depreciation, which just lowers your taxable income not your actual income in your hand, he explained this in a separate letter to you with the depreciation sheet. He also attached the 2 previous years showing the same gross income as 2004 before the depreciation. We do not understand why therefore we have been sent the RFE? We also listed assets that are way over the requirement for 4x the difference

Her - that is 5 x

Me - still we are way over the required amount

Her - are they liquidatable assets

Me - yes they are 3 properties and 2 vehicles plus savings etc

Her - did you send the deeds etc

Me - yes

Her - (no response to this at all)

Her - Has he filed his 05 taxes yet

Me - yes we are waiting on them

Her - is the income the same as the other years

Me - yes

Her - will you have the same problem

Me - no because there is no depreciation in 05 (!!)

Her - well send those taxes in with a letter explaining again about the depreciation

Me - but we meet the requirements right now

Her - well I can't see why the service center made their decision to send an RFE

Me - maybe it could be because the person looking at the file does not understand tax depreciation

Her - yes that could be the case

Me - ok we'll send them in. will it then be ok

Her - yes it should be

!!!!!!!!!!!!!!!!! Great - so because potentially someone at the service center does not understand the basics of finances/taxes when you are self-employed, we get an RFE. And despite the fact we have way more than the 5 x the difference from the income to the poverty level in assets, they are not applying their own rules it would appear.

I think you can guess how truly f#cked off we are right now.

Yes absolutely - that is what the top line of the RFE says ' the household income on Form I-864 does not meet or exceed the required income'
