Just out of curiosity, if the K1 is denied what is the best route to take? Try and keep the case at the embassy and immediately get your senator involved or get a lawyer. If lawyer, an in-country lawyer or American. I am just curious. Also would it be of any help , if the petioner happened to know someone who was "high up" in politics (ie: former congressman, former presidential cabinet member, lawyer) to contact that person to see if they can do anything to let the Consulate know that the case is being watched? Sorry if I am being deliberately vague here. Please no flaming. Just some hypothetical questions.

The best course of action depends on why the petition was denied. Further keeping the petition at the Consulate is important, once its back in the US its pretty much dead.

Name dropping will not help. Involving people who can help is a good idea if there is a problem (like being way behind processing guidelines).

The CO at the Embassy interview has the ultimate authority to approve and deny. A Congressional inquiry would not go unnoticed, but by itself can change very little.

Not many cases are flat out denied, rather they are put on Administrative Review when more information may be requested, or for the Embassy to verify documents, etc. This "hang time" could take months and rarely will they let you know exactly what is going on, or what item(s) they are questioning. Most reasons for inadmissability are found on the back of trhe DS forms. Discrepancies found at her medical interview will be passed along to the Embassy as well.

A checkmark on the 221(g) from given after the Embassy interview, "WAIT UNTIL YOU HEAR FROM US" is the sign that you are under Admin review. If you can be present with your fiancee' at the time of her interview, you probably will be able to find out more than they are able to tell her.

If you are aware of something that may be grounds for denial, proactivly research for a waiver that might excuse the situation.

IF they say they are going to return, yes take all measures to keep it there. Call, write keep calling and checking stay on them with your state rep.....all you can do is try to keep it there. If it is returned your pretty much out of luck and will need to refile or marry then refile as married

Hi,

My K1 Fiancee visa was denied this past Friday due to my fiancee being unable to answer 4 questions to the interviewers satisfaction. Each of the questions he was unable to answer satisfactorily have a reasonable explanation. I have faxed my congressman, and emailed the Consulate requesting a Senior Officer review the case before being sent back to USCIS. Any suggestions as to what else I should do? How do I communicate the explanation to the Senior Officer? Should my fiancee also return to request an additional review?

Well, oru k1 was not denied it was put on AP. I called my senator right awayand his rep immediatly sent an email to the embassy. Im not sure if it helped or not but our visa was delivered in less that 6 weeks. I say it does not hurt to ask your senator for help, whats the worst that could happen by haveing them help you
