Okay here goes. We received a NOID in April, 2009 wanting documentation to support an issue we are having. The NOID told us what to send in and the last paragraph was that USCIS would not be making a decision before June 29. We sent in our reply, via registered mail, and USCIS received it on May 29, 2009. June 30 came and went. We contacted USCIS who put in an email inquiry to be responded within 45 days. We called our Senators office. He sent a letter to us last week and said that we were denied on June 15 and a letter sent on June 16. The letter we received from USCIS dated June 16 was the identical NOID letter received in April, just the last paragraph indicating that they would not be making a decision before June 30 was deleted. This was not a letter of Denial. Called USCIS again yesterday and she asked if we would like the Denial Letter sent out again, of course. It wasn't her fault that US postal services did not deliver it to us - we would have to take that up with them. We have always gotten any written communication from them. However, the 30 day appeal period has passed. We want to appeal and she said that she would do an email to the proper department. We have faxed the 2 NOID letters to our Senator and maybe he can help us.

What I am inquiring about what is everyone's opinion about an appeal vs. getting married and filing the CR1? I am just beside myself with this stuff.

I think it's time for a consult with an immigration attorney.

How does a person go ahead and find an immigration attorney that knows what to do. I have spoken to a few who claim that they know but didn't get this immigration denial. I guess people here aren't allowed to name ones that they have used?

im so sorry to heare that !:(arent u one of adam Walsh filers like me?how come they denied u if you sended evidences they acsked was not enought for them?...did they told u what was their reason?

Im sincerly so sorry for you i hope u can find a good lawyer to defend your cause

Hi tgorety!

I know how hard and painful it is because apparently our petition had been denied by USCIS and we chose the option of appeal. However, we are still awaiting for results running 6months now. The sad part of it is that there is no timeline for an appeal. I see some who re-applied the petition and were approved already. Others got married and filed for CR-1 now got an NOA2. So it seems like it's better to re-apply or file CR-1 as there is a specific timeline....rather than waiting forever...

01/05/10 - Visa on Hand

01/16/10 - POE Seattle Tacoma airport, WA

02/03/10 - Received SSN

03/09/10 - 2nd year Anniversary

04/12/10 - AOS, EAD, AP Application Submitted

04/14/10 - USCIS received package(AOS application)

04/22/10 - got email notification receipt number

04/24/10 - Received hard copy I-797 notice of action (AOS, EAD, AP)

04/30/10 - Biometrics notice thru mail

05/11/10 - Biometrics Appointment

depending on the circumstances of the first denial, can it be fixed or is it something that isnt going to change even if your married?...we married and had no problems
