hi my friends, i´m so sadddddd :( because my visa was denied in Feb.08 my hubby was with me but I'm confused, let me explain to you.

First window = questions about me and my husband aprox. 25 minutes,Woman told me that I need some aditional papers.

Second window= take a fingerprints only one finger

Third Consul room= She asks separately my hubby and me all questions about my married, My hubby and me answered our true story, but finaly SHE told me (""I can´t to give a visa because you answered different than him)" she told me YOUR CASE will send to back DHS and your hubby had to appeal.

I´m feel badd help me please ...what will happen? anyone visa denied?? hereee??? what i have to do???

PD: I was overstay in USA 4 years and the consul never told me about that only DIFFERENTS ANSWERS, NOT NEED WAIVER 601. why???? :(:(

Really sorry to hear this I understand how stressed and sad you must be in this situation, I think your husband need to go back and file for an appeal.

The petition will be returned to the consulate and a Motion of Intent to Deny will be issued by the Service Center. Your husband need to retain legal counsel now to get this resolved and put together the best appeal to the Service Center.

Your husband will have to do some research and appeal the denial of your visa. A Lawyer is not necessary to file an appeal if your husband has done all the research and is comfortable doing the appeal himself. They did not mention an I-601 because they denied your Visa. If you do appeal and get an approval, you will still have to file the I-601 to overcome your inadmissability for the overstay.

The consul told me that my case will sent to DHS and they will sent to my husband a letter and then he cans appeal so how long will take this process?? i never heard about that?? why they never told me about a waiver for overstay in USA? will I need?? Anyone like me situation????

I am really sorry to hear of your denial *hugs*

The petition will be sent back to DHS with a recommendation for revocation to the NVC.

3. Revocation cases will be forwarded to the NVC for review and

data collection, and forwarded by NVC to the appropriate BCIS

Service Center. Cases will be returned from the BCIS Service

Center to the NVC and then routed back to the post of origin.

8. When a petition is returned to DHS, if DHS concurs with the

officer''s recommendation, DHS regulations require DHS/BCIS to

provide the petitioner notice of intent to revoke, and to allow

the petitioner an opportunity to rebut the grounds for

revocation

eludy, was your husband required to go to the interview? i don't know if this is good advice or not, and hopefully other people will comment on it, but if they're trying to play you and your husband against each other like that and he's not actually required to go, maybe if you just go yourself then they'll not be able to do something like that next time. from what i'd read before, i thought the USC wasn't required to go to the interview, so i don't know how they were allowed to do all that stuff they did with questioning you two separately. Are your requirements different? Did he have to go to the interview too? Can anyone comment on this idea? Would it help her? Is it seriously flawed?really makes me wonder if i should go for my wife's interview if that can turn out to hurt us. :(

I have read of some cases from in the old site where cases where hurt (similar to the OP's story) and cases where it has helped. I don't think there is any difinitive answer on this one.

We were denied a visa in Peru in 2004. It took about 6 months for the case to get reopened. It would of taken another 8 months or so for it to go through the process. In the mean time, we were married in Peru, filed the K3, had it approved and now my wife is here in the states. Once your petition is denied and sent back to the states, the porcess becomes very drawn out.

Hi STEVE thanks so much for your help but i need to know more information about your case. My visa denied is CR1 , is different?? than K3 ... what my hubby had to do? wait a letter?? from NVC right? explain for me please. :thumbs:
