Better now than latter. If one of the people isnt happy with what they see then get out before its started. Perhaps this person feels that they only wanted to come here for the green card and his is not up for that. It does kind of sound like that in the post.

"she doesnt want to go back" well it doesnt matter what she wants she has to go back if he is not willing ot marry her. After all isnt that why she is here becasue she loves her man? Or is it becasue she wants to be in the USA?

My friend just called me and she said that her fiance wants tro send her back home. he doesn't want to get married her. but she wants to stay. is there any fine if fiance doesn't get married within 90 days? if she reports to immigration center can they talk to him and make him change his mind i mean some psychological session ?

She has 90 days to get married. If she doesn't get married within the 90 days to the petitioner, she will be out of status. No way around it

I suppose you could look at the time and money that he invested in the process that he is essentially now throwing away as a fine. Ask yourself this have you ever heard of someone being fined for breaking off an engagment, immigration aside. The answer is likely no, if you're being honest with yourself.

The poll they ran on the TV station web site is even more interesting. Out of more than 18,000 voters, 74% strongly disagree with the jury's decision.

Most states have abolished "breach of promise" laws. They had a use at a time when a woman's reputation would be severely damaged by fiance backing out of a marriage promise. Suing under breach of contract laws is rarely successful. I'm surprised the jury gave her a nickel.

There is no one that can make that person marry someone. She or he will have to leave the USA within the 90 day, no exceptions, sorry.

They must get married within the 90 days.

The only thing she should realisticaly expect is a ticket home on his cost.

Have they considered counciling or anything of the sort - as a last ditch effort I would strongly reccomend it.

If there is anyone that can make him change his mind, it would be his family members and NOT immigration. They are not marriage counsellors or anything of those sorts. If the guy no longer wants her, why would she want to stay though? It's a sad situation but if he doesn't marry her within 90 days, then she needs to go back so as not to be out of status. There is no fine for the USC.

If he spent all that time and money then backs out, its either he is a glutton for punishment or he is suddenly extremely uncomfortable with the relationship. Either way, he cant be forced to do anything he doesnt want to do so if he says no more then she has to go back. It sucks but there is no way around it... Good luck

Her fiance cannot send her back home because she is not a parcel. If he doesn't marry her within 90 days then its best if she goes back to her country.

Her fiance cannot send her back home because she is not a parcel. If he doesn't marry her within 90 days then its best if she goes back to her country.

Hey everyone, I know the he went to a lot of time and expense to get her here but that is a small risk when you consider that she left everything behind for him. All he has lost is a little time and money. She, on the other hand has lost her job and probably her place to live. Not to mention the social stigma of retuning after being with her man for three months without a chaperon. At the least he should support and offer to help her get her life back together when she returns. Then again I am old school and cherish women and know they should be respected.

Having said that, we don’t know his side of the story, people change when they start living together. None the less, he has made a promise to her and entered into an implied contract and has some moral obligation to her, as well as she to he. Perhaps a little counseling and a lot of prayer are in order here.

I don't get why so many "couples" view this as some sort of business transaction.

Where is the love?

There are no fines, no "immigration center" making anyone do something they don't want to do. We don't know the whole story here and we don't know why the USC decided not to get married.

What we do know is that on a K1, you have to get married within 90 days of entering the US. If that isn't going to happen, the beneficiary must go home. It's as simple and as heartbreaking as that.

I wish your friend healing and love during this hard time. Hopefully she finds the right one for her in the future and it doesn't mean that the right one is an American either....tell her to follow her heart and be true to herself.
