I just got the best letter from USCIS today. I was so excited that I was on my way to the gym and left my water! So, since I came back to get it, I decided to go ahead and share my blessed letter. Some might not see it as good, but I do, considering we are married, and I went ahead and filed the I130 without the official "closure" letter from CSC. Today, closure has come, and I am free to refile :devil: They will soon find out that they have over 11 pounds worth of information waiting for some innocent soul to review :devil:

Notice of Decision

This notice is in reference to the Form I-129F, Petition for an Alien Fiance, filed for (fiance), pursuant to section 101 (a) (15) (K) of the Immigration and Nationality Act, as amended. The petition was approved on August 4, 2008, and was forwarded abroad to a US Embassy/Consulate with a validity period of four months. Subsequently, the petition has been returned to the USCIS with a finding that the beneficiary was not issued the requested K-1 visa. Since the period of validity has now expired the petition will not be revalidated. Therefore, in accordance with 8 C.F.R 214.2(k)(5), all USCIS action on this petition is concluded as of the date of this notice. However, the petitioner may choose to file a new Form I-129F, Petition for an Alien Fiance, for the beneficiary with a fee.

This eases my mind since K1 is now useless for a now married couple. They received our petition back on February 4. We filed the I-130 NOA1 June 29, date of this letter, July 15. I say all in all, 5 months and 11 days to review an expired petition is not bad. We weren't expecting to hear anything, if at all, on our fiance petition. Which makes me wonder if they really did look at the I130, which I referenced the I-129f over and over again and pulled my file :unsure: . The last "touch" of the I129F was July 15, probably for this beautiful letter. :dancing:

Yes, you are right, amiga :) The reason for the excitement was I was so afraid they would re-affirm like Vermont has been doing a lot of lately. We would have hell to go through if they kept the old case open. And now when the husband goes for the interview (just in case I cannot get the time off) if they bring up the previous petition, we have the confirmation that it is dead. Everyone told me when we first heard that they were sending it back that we had to make sure that we have the proof that we can re-file, so now we do. We just filed 15 days ahead of time :whistle:
