What happens if your SO loses their job or gets laid off right when you are about to get an interview?

Hi guys!

Questions for you.

If my fiance were to get laid off now, what would happen when filling out the I-134.

We have a co-sponsor that makes more than enough money but how would the I-134s be filled out if my fiance DID get laid off now?

Another scenario: what happens if my fiance gets laid off just as I get approved and am about to move there?

How would this affect the AOS financial documents (I-864?)?

The reason I ask is because they are laying off people at his company as I write this and it may happen this week or it could possibly happen in 2-3 months to him. I would really like to be prepared for either scenario.

I know he would try to find another job immediately but I don't know how this would affect us now before I am approved or right after I get approved and have to deal with AOS.

Keep in mind that if he is laid off he can likely apply for EI and that counts as a source of income. It may not be enough without a cosponsor, but it is income. In either scenario you described, if your fiance gets laid off and you'll need a cosponser at some point (before or after the interview for AOS). You need to prove sufficent income with your 2008 tax return, and an ongoing source of income (ie. pay stubs, letter from your employer)

Krikit, did you mean that if he were to get laid off now and found a new job right away that that would be the info he writes into the I-134? You wrote I-864 so i got a little confused.

Oh, sorry, Domegirl. Way too many form #s in my head. :lol: I-864 is submitted with the AOS and is the same thing..... affidavit of support. I can't remember back that far but I guess the I-134 is the one you use for the petition.... it's an affidavit of support too.

I'm trying very heard not to freak out right now. We are pretty sure he will be laid off and thats NOT good as I wanted to send in the papers to get the interview date this coming Monday.

I'm pretty sure that his taxes for the past 3 years will show that he did not make enough to support me financially. Maybe for a year and a half but definitely not for all 3 past years because at one point he was freelance writing from home making approximately 16,000$.

I know that if he got laid off this Friday he would definitely have a fire under his butt to try and find a new job immediately. I'm not worried about our co-sponsor's salary at all. I'm mostly worried that if he does find a new job, the interviewer will say something about him only being employed there a month or maybe a little more than that or maybe his new employer would not want to supply us with a letter from the company stating he's employed there. I would at least hope the interviewer would be happy he found a new source of income but who knows.

Honestly, I wouldn't worry about it at all.

Lot's of people have been through interviews and the AOS process with spouses with little incomes.

As long as you have a co-sponsor, you should be just fine.

Thanks for the responses guys. He's pretty sure he's going to be laid off this week. I'll let him know tonight to get on the job hunt immediately and I'll help him look as well through the online newspapers.

I won't stress about it. I'm sure it'll be ok whatever the outcome.
