In feb of 2010 we will have been married 2 years can we file anytime after that , In sept 2010 it will be the end of his 2 yr greencard. I know they said at the interview before 3 months of exp. is there a limit to how many months before exp. that you can file?

It is 90 days before the expiration date if the current green card. What is the exact date? My hubbys was 9.21/2007 we we eligible to file 6/23/09

Yep - 90 days. And don't try to "play" the system and send it in early (say 3 days before the 90 day mark) - they will reject it, even if they get it after the 90 day mark.*

You are eligible to file from 90 days before the expiration of the GC. It has nothing to do with your marriage anniversary.... All the best!!!!!!!!!

Your NOA1 also serves as an 'extension' letter, which extends your GC for a year.

It almost definitely will take more than 90 days to process. When you send in your application, you will receive an NOA receipt that will include the phrase that the NOA extends the status of the green card for one year and is good for work and travel purposes. You need to make a copy of the NOA and then carry the NOA and the green card together because they now make one complete document - the expired card and the extension letter. Ideally, your 10 year card will be approved before the NOA expires.
