Vaccination Supplement not completed when filing I-485

Hi All,

New member, but I have been browsing here for a while.

Question:

My wife came into the US early Jan. 2009 after getting her K-1 Visa in Juarez, Mexico in October 2008. When she came into the U.S., she was 7 months pregnant. We got married a week after she came in so I could put her on my job's medical insurance, and we were also covered on the requirements for the AOS. We applied for the I-485 through a lawyer (same one that had done the K1-Visa). Reading through forums, I have found that we didn't go to the medical to at least do the Vaccination supplement, form I-693. We got a Request for Further Evidence in March, something relating to needing a copy of the NOA2 for the I-129F for the Fiancee Visa, and it was sent out. USCIS received it on March 19 (it says so the case status at USCIS website). We have heard nothing since.

We filled the I-693 with my wife's info only, but didn't go to the medical. Could this be what is slowing hte process? She hasn't even received her EAD or her biometrics interview, nothing. Right now I am really frustrated and annoyed with the Lawyer, as it seems their ineptitude has made us lose valuable time. Time in which my wife's family has not been able to meet our baby daughter due to this situation.

Any recommendations on what to do? Any thoughts? All are welcome.

January 2nd, 2009 - entered US on K1 Visa

January 10th, 2009 - Married in LA

February 12, 2009 - applied for I-485 AOS through lawyer

February 19,2009 - NOA1 received for I-765 & I-485

July 29, 2009 - get infopass appt. and ask about status of applications since nothing has happened. Told EAD had been approved April, 4,2009, but never received. Unclear what happened to it.

August 3, 2009 - Biometrics letter received for both EAD and AOS

August 13, 2009 - Biometrics appt. USCIS.gov "touched" EAD, card to be sent out. Finally something!

August 21, 2009 - EAD received & approved

September 4, 2009 - Interview date received

October 6, 2009 - AOS interview in Los Angeles, CA. Finally!

October 6, 2009 - APPROVED!!!!

July 15, 2011 - Applied to remove Conditions I-751

July 21, 2011 - Received NOA1

August 16, 2011 - Biometrics Appt. 12:00p.m. (received 7/28/11)

October 19, 2011 - E-mail approval/"card production ordered" received!!!

They will ask for it whenever they notice its not in there. I would advice you get the vaccinations she got for K1 transcribed by a Civil Surgeon so whenever they do ask for it, you will have it ready to be sent out. All the best..

There is nothing you can/should do right now, until you hear from USCIS or it goes past 6 months since you sent the case in. Once you get an RFE or an interview appt, you will know what to do. If it goes past 6 months, you can schedule an INFOPASS appt to get a case status in person.

I agree that your lawyer is a clueless. A good lawyer would not let you send AOS out without all the supporting evidence (i.e. NOA2 & required medical). Now you know why the majority of people who not recommend using a lawyer. This is so straight-forward for most people that a lawyer is just another person to screw things up for you, besides everybody at USCIS.

But since you have probably paid him already, firing him now does nothing except let him off the hook with the money in hand. If you haven't paid him yet, fire him. You have cause in my opinion.

If you didn't include a medical form (I-693 or DS-3025) with AOS, they will undoubtedly ask for it, either through RFE or at the interview (if you have one), there is virtually no chance they will approve you without one. So I would go to a civil surgeon and get the I-693 filled out.

If you didn't include a medical form (I-693 or DS-3025) with AOS, they will undoubtedly ask for it, either through RFE or at the interview (if you have one), there is virtually no chance they will approve you without one. So I would go to a civil surgeon and get the I-693 filled out.

I believe the I-693 was included, but only the basic personal info was filled in. The vaccination supplement that I believe is required was not done. Should I go get it filled out and wait for the RFE or should I go get it filled and just send it to USCIS?

To me, though, I'm still unclear why USCIS has not responded and sent out another RFE for the vaccination or the EAD or anything really. If I got anything I would welcome it, so long as I knew the case was being looked at.

Definitely do not just send it in to USCIS. They will most likely not match it up to your file.

You will either get an RFE or an interview notice. Send it in if you get an RFE, or take it in for an interview.

If you don't do the biometrics, you can't get an EAD. So that is why you have not gotten the EAD. Since it has been more than 90 days since you applied for the EAD, you are outside the processing times for EAD, so you could INFOPASS for that and see if you can get your case moving.

Also are you sure that your lawyer didn't just send the DS3025 as you vaccination supplement instead of the I693 if all vaccines were previously completed?

04/18/2008 - both of us are home at last, POE JFK!

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

UPDATE: Got Biometrics and now got letter for Interview (YES!), but still don't know what to do about the Vaccination supplement. The Interview sheet says I should have the medical or the supplement done with the entire list of things they ask for the interview. My wife didn't have to do vaccinations at K1 medical in Mexico because she was K1 or pregnant (not sure which). But she can get her vaccination records from Mexico that she got them all done. Should we go to a civil surgeon nearby and get it done before going to the interview? Or wait to see what they say at the interview? I'm leaning towards going soon to the doctor, but will he send it to USCIS, which may be lost as stated above?
