Visa denied in Montreal, must show domicile

Timeline

Just an update, we have emailed the consulate three times now and they have e-mailed back each time basically telling us to be patient and that it is under review. The sheet they gave us specifically said we would hear from them four weeks from when they received our papers, but four weeks passed on the 24th and still no reply. I guess they will be getting another e-mail on Monday. I don't know if any of you have seen the movie "Brazil", but I am feeling very much like Sam Lowry right now. Don't mess with Bureaucracy because Bureaucracy will mess with you! ;)

My husband had his interview for his CR1 visa in Montreal on June 15 and was denied because I am in Canada with him presently. They asked him to send in documents to prove my domicile within the states. I have maintained a domicile within the states and so we sent documents showing that in and our tracking number showed that it was received in Montreal on June 26. His interviewer said that he would get a reply really quickly, but we haven't heard anything yet and we're getting a little stir crazy! Has anybody else had this experience? And if so, how did it turn out for you? Thanks for any help. These last bits of waiting are brutal :wacko:

Have you received your visa now? If so, when did they respond? I'm in the same boat and sent the domicile evidence last week. They emailed me back confirming receipt and that they are reviewing it.

Sorry to hear about the hang up over domicile. Yes, I wonder if kristinelder has received the visa yet!

Please keep us updated on when you receive your visa as well. Domicile seems to be becoming quite the issue with Montreal.

Will do - I have read a lot of good information here. I applied for CR-1 visa as my wife if the USC and we live in Toronto since we got married in 2000. Now we have decided to move to US and we started the process on sept 11, 2008, DS230 and list of documents sent to Montreal on November 5th, 2008. Missed my first interview apt on Jan 20, 2009 as I did not receive the apt letter. I did not find out about the missed apt until May, 2009. Actually I found out about the second one via email as there are issues there (MTL) with mail. My interviewed was scheduled for Aug 9th, 2009 and was denied due to domicile issue. Consular told me send documents such as school registration, job offer, residence lease with passport and they'll issue the visa. That was sent on Aug 17th.

Will do - I have read a lot of good information here. I applied for CR-1 visa as my wife if the USC and we live in Toronto since we got married in 2000. Another VJ member, who posted earlier in this thread, also had the domicile issue, it took them 2 weeks to get approved and then there was mailing time.

Start emailing them. I don't know how backed up they are now, but ours took around two weeks to get it approved. (found out in email) but didn't get the passport back till later, (though it was holiday time too and mailing to newfoundland in the winter)

Thanks - That is certainly encouraging. Keeping my fingers crossed. Wouldn't mind if others can share their exp on timeline.

I have another question - not sure if I should open another thread. I'm going to be transferring within the same company in the US that I work for in Canada. Can I work as a canadian empoyee on a project in US for the transitional period (while I wait for SSN etc.) after visa is issued?

You can work as canadian or a US employee since when you get your IR-1 visa, they will stamp it at your POE and its basically your temporary green card for 1 year after that and you are legal to work.

yeah I remember when the lady told us "he could have the visa before Christmas", I basically told her she was full of it lol. But it was much faster than what I expected, because I was ready for another 2 months of waiting.
