Maiden Name on EAD, Want Married

We FINALLY recieved EAD today. Although we told the lady at biometrics, AND signed EAD document with married name (sognature on card), it was issued with maiden name.

AOS and I-765 was completed with maiden name. (Now we know to complete with married)

Called USCIS, official stated we need to send back EAD card with a new EAD application (requesting replacement). He also said it would be up to who reviewed letter if it is our fault or an error of USCIS (No Fee vs. Fee).

We did not get SSN before K1 expired, so we are really wanting to get SSN with EAD, but we want MARRIED name on SSN card (for ID and Banking and etc.)

SO, question 1) Do we send back EAD and take the risk of a fee (new EAD application $385) to change name? :(

2) Just wait, go ahead and get SSN with maiden name, AND hope we can change last name at interview?

3) If interviewer sees EAD in maiden, will it be a problem?

4) Get SSN with EAD with maiden, THEN send back in requesting replacement with MARRIED name?

Our process so far has taken much longer than most. So, the less confusion on their part and/or avoiding any other delays is the goal.

All of your help and advice are greatly appreciated.

I find myself in a similar situation, I received my EAD card with the wrong birth date on it I am pretty sure the chances of USCIS saying "yes we made that mistake" are slim (even though everything else, AP and supporting documents all have my real DOB) so I am just going to await my greencard.

I did however get my SSN 2 weeks after I arrived in the USA because I couldn't get married without it, so my SSN is in my Maiden name, everything else in my married name.

For banking you don't have to have the ssn in your married name, I took my British passport, SSN in maiden name and Marriage certificate and we opened a joint checking account (I had to specify that I wanted to use my husbands name) was quick and easy (of course experience will differ by bank etc;).

EAD in maiden name wont be a problem, the EAD is temporary only until you receive the greencard.

I know it is written constantly in these forums but you should make a timeline.

29/06/2004 Met online

24/10/2004- Officially started dating!

-Various Trips Between the USA and Scotland-

25/12/2007- Steven Proposed, and gave me a lovely Ring!

29/02/2008- Sent I-129F to VSC

22/09/2008-1pm - Recieved Visa!

04/11/2008 -Steven comes back to Scotland for the Celebrations!

09/11/2008- We return home together!

23/01/2009- Wedding!!!

Your I-129f was approved in 108 days from your NOA1 date.

Preparing AOS Forms.

09/4/2009- Sent AOS

11/4/2009- Received and signed for

20/4/2009- Received NOA for AOS/EAD/AP (Dated April 17th)

20/4/2009- USCIS cashed check for $1010

09/5/2009- Biometrics

11/5/2009- Case transferred to CSC

05/6/2009- Received AP

09/6/2009- Received EAD

22/7/2009- Approved!

27/7/2009- Greencard in Hand

Removal of Conditions.

15/5/2011- Received @ VSC

23/5/2011-NOA1

12/07/2011- Biometrics

Yes, you will be charged a fee if you filled out the form with your maiden name, and now you want a card in your married name.

Wait for the greencard. If you get interviewed, maybe you can get them to change it at the interview. If you get approved without an interview, you can just pay the $400 for a replacement greencard.
