I just received an RFE stating I do not appear to meet current poverty guidelines, and I "may wish" to submit additional I-864 for Joint Sponsor, and some additional instructions If I decide to use a joint sponsor"

Well I know this, I am planning to support her with assets which are substantially beyond what the I-864 instructions require for assets sponsorship.

The RFE also includes a required document to submit, the DS 230 Part 2.

A little Nervous now, I know my assets are more than I could work at a poverty level job for the time frame I'm required to sponsor her. Hopefully this is just a standard warning since they seem to prefer the steady income.

Any wisdom or comfort anyone can offer me about Assets for support would be welcomed.

What did you list for assets on the I-864? Property? Cash? Auto? Stocks?

Did you address this paragraph in the 864 instructions: Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basisfor the owner's claim of its net cash value.

Yes I did

I listed 2/3 Cash and 1/3 Property. The Cash alone is about 6x the requirement of Assets to be 3x %125 of poverty. I did not list my Stocks and IRA's or vehicles. Would it be wise to draw up a letter of credit or NET worth from the bank for the Embassy to see? I included Bank Statements and Property appraisal with the I-864

OMG! Qiix, I completlely understand how are you filling now. My husband included his assets too, savings, and it was over the requirement to qualify. We were regreting because he didn't include property, and as I see you did and anyway you got the same checklist than us. And we don't have a joint sponsor either. Is like NVC just count income itself, and maybe, as you said that checklist is just a warning. I just talked to our attorney and he said, it was more than enough to qualify. So we shouldn't get panicked and wait for the best, to be approved!!!. When are you having your interview? Good luck ;)

I am currently waiting for our NOA2 (we filed in April) but wanted to clarify before we get to the next level some income questions.

1st; I am on disability and therefore do not qualify as far as income, however, we have been very diligent and saved well over the 6x 125% poverty all in liquid assets (I am assuming that CD's count as that??)

2nd; My husband had worked for a cruise line for the past 14 years but had to quit to do this process. He is our main support as far as income.

3rd: He signed a contract for a job here in Florida where we live and is doing training with them now in Europe.

My questions are as follows: Can we count his income from his past job or submit his new contract as proof of income?

Or is the amount we have in savings sufficient without signaling an issue?? :blink:

Just wanted to get some input before we got to that stage as I am praying that any day now we will get word that we have been approved for the I130.

Yes, you can submit the contract as proof of income. Its always easier when going with income then you can file the I864EZ. If you have enough income, I recommend this over the regular I-864 and omit assets. BTW, disability income qualifies as income.

But on my tax transcripts, it does not show up... Social Security income is not shown on tax transcripts nor add to the Gross Income?? Not sure how I can count it? Should I submit my bank statements showing the deposits from the Govt??
