Hello,

I have some strange questions. I looked trough the other topics but I could not find answers to my questions. I hope I did not miss them.If I have, please exuse me, however I am eager to fing out the answers so I am posting a new topic. I am going to tell you briefly about myself and our situation. We are from a European country that requires to obtain a visa in order to go to the USA. We are searching any opportunity to go in the states. We did not have a chance for the DV 2010 Lottery so we are trying to find another way to make our dream come true. My questions are as follows:

1. If I get accepted in university studying master's degree and they issue me a student visa, will my fiance be allowed to come with me?

2. What kind of visa will he obtain in this case?

I know that neither I, nor he will be allowed to work there.

No, your fiance will not be able to travel with you on your F-1. The F-2 derivative is only issued to spouses or children of a F-1 holder.

And yes, you can work while on your F-1; however, your employment is limited to employment at your school and is only part time.

Good luck - and remember that a student visa is a non-immigrant visa.

once you are married to the fellow he can coat tail on your visa. be sure to read the specific rules, as it may be to your advantage to be married before your student visa is issued, or it may make no difference. i am not sure.

I'll also add to the post above that you could request working permit (OPT) 6 months before you graduate. Also, once you get the OPT you'll have only one year to work legally in USA. At this one year if you're able to find a sponsor for H1B (another working visa) you'll be able to change your status and stay legally in USA for at least 5 years (that's for how long the H1B is good for). If you're married, your spouse should be able to come over with you. If not married - he won't be. In your case even if you get F-1 visa and do go to USA, your BF will not be able to follow unless he's not applying for an F-1 as well. Good luck! :thumbs:
