Hi all,

I got my US citizenship last month; sorry I’m not familiar with this site (just heard about; and please forgive my ignorance here with all the forms). I have couple of questions with respect to AOS for my wife:

Background:

Met my wife (Gigi) in April 2007 (Student with F1 Visa and the expiration date was Apr 2008); … moved together in Jul 2007 (real love)…... got married in Oct 2007 (in San Francisco), … extended I-20 to Mar 2010; and we have a beautiful baby girl in Jul 2008 (long story short). Now she back to school.

1) Do we have to fill I-130, I-485, with I-864 and G-325a (for both of as; or G-325…) only? or more forms?

2) Can she apply for I-131 (for a trip to Europe)?

You help is really appreciated

1) Yes and I-693 medical exam from a USCIS designated civil surgeon. G-325A for both on the I-130, G-325A for only the alien for the I-485

To the I-131 question, yes she can if she maintained her status in school. However as I have heard and read, the AP does not guarantee reentry so unless for an emergency you may want to sit tight for the whole process.. Good luck!

If your wife has overstayed or been out of status, it is not advisable for her to leave the country till she gets her GC.
