Question # 1:

Is it true that in the Philippines, when you get married, your name is automatically and legally changed to your husband’s family name without having to file a legal name change? My parents’ marriage took place in 1972. Their marriage certificate did not indicate that my mother had a name change then. But ever since I was little, my mom had been using her married name.

Question # 2:

So this exact name (i.e using my dad’s surname) which my mom confirmed to be her legal name is what I used on my I-130 form (petition for alien relative).

However, my birth certificate shows that my mother used her maiden name at time of my birth registration :wacko:

I don’t know if this would cause a problem in showing proof that she and I are related. :blink:

So – I am thinking of sending the following documents as part of my application:

1. Copy of my birth certificate

2. Copy of my mother’s certificate

3. Copy of my mother & father’s marriage certificate

4. Copy of my mother’s current passport as evidence of her current legal name (her passport shows that she is using my dad’s last name and not her maiden name)

Would these documents suffice to show proof of relationship?

In California, a married woman has to show her current ID and a marriage certificate at the DMV to change her last name to that of her husband on her driver's license. Women change their last names to their husbands' all the time. All a woman needs in CA to change her last name to her husband's is a valid marriage certificate. http://www.nolo.com/article.cfm/catId/2117...CA/118/121/ART/

If the legal procedure in the Philippines is similar to California, your mom should not have any problem with the name change.

You also will need to submit your proof of citizenship; either a copy of your US passport biographical data page or certificate of naturalization or US birth certificate.

Thank you aaron2020. I got my mom's copy of passport and submitted the application on August 7th along with all the necessary documents including copy of my proof of citizenship.

now....it's waiting time...thanks for your help :)
