Hello all,

I just gave some new about my last visti to the U.S. Embassy in Paris.

Things went well, the the details if interested

I'm jut here focusing on one thing: they asked me to produce o police record from China, because I studied and traveled there, totalizing more than a year (but no one stay was up to a year)... and of course, China is such a country that such documents can be obtain only... in China.

I gave details about my visit to the Chinese Embassy in the thread above.

Did this can of thing happened to anybody? What if I cannot provide this document?

Advice welcome!

May 12, 19, June 2, visits to Embassy to check status: nothing new

June 30: visit to Embassy, learn that file went back to the US

June 30: NVC representative said that file was sent back on June 23.

...

Went to Embassy Friday, July 7: file is back. They are ok to expedite before wedding date.

But one missing piece: need a police report from China...

...

Mid-July: Friends helping in China, and Police report on its way.

Called the U.S. Embassy and said I was basically ready. They agreed over the phone to scheduled the interview for Aug. 10.

Arrived in California on the 17th.

Sept. 2: Married!

Nov. 25: Biometric appointmenr received

Dec. 2: Biometrics

Hi! I live and work in Taiwan (Republic of China) for 3 yrs. and I am required to submit police report when I came here to U.S. I did went to chinese embassy in the Philippines (my country) and get an application to acquire police report from taiwan. they give me all the information with the forms. you have to send the application with the copy of alien resident card, copy of passport, required application fee, and returned address envelop with a stamp. it took like about a month to get it to you. but I did sent all my documents to my friend there and she took care of it in my behalf which make mine faster. I don't know if it would be the same in your case but I am sure the chinese embassy there would be able to help you. Good luck!

Thank you, sharing your experience helps. I already contacted a friend in Chian. I'll go back to the Embassy on Monday, see what they can do. If they can at least give me the list of what I am supposed to provide!

My finace spent five years living in Japan and so she had to get police records for her stay there. She went to the Japanese consolate in Montreal (she is canadian) and they were able to take care of her, however it took three months for that one bit of paperwork to get processed and given to us, so don't be surprised if you have to wait awhile.

Thanks to all to share your one experience.

I am actually trying to get that rule right, while friends are trying to help in China.

Does the rule says that a police record is required for countries one lived in for at least one year CONTINOUSLY, or is it cumulative time.

I went many times to China, but never spent a year (max 10 month). In that case, does it aplly to me... The lady I saw at the Embassy seemed to thnik so... but I have doubts.

I anyone know that rule for sure. Could not find it on the DSH website.

Follow up on police record for China: The fun thing is that one can get it only in China, at a local PSB of the county of previous residence.

What do you do when you don't know anyone anymore there that could help you getting it?

And when the Chinese Embassy tells you they can't do anything... And when the French Embassy in China tells you that most probably you'll have to fly to China?

For those who might need it one day, here is the info for China from the "reciprocity tables":

Individuals residing outside of China may obtain notarial certificates from the notarial office with jurisdiction over the county of previous residence. Chinese relatives or friends may request issuance of certificates on behalf of someone now living abroad. Relatives and friends should have specific written authorization from the interested party before they request certificates. Alternatively, persons in need of notarial documents may contact the PRC Embassy or Consulate nearest to their residence abroad and ask that the request be forwarded to the appropriate notarial office. Obtaining a notarial certificate through a PRC Embassy or Consulate can require considerable time.

POLICE RECORD

Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate. This is the case for persons sent abroad for education by the Chinese Government who fail to return to China.

According to a 1957 state council ruling that is still in force, the imposition of a re-education through labor (Lao Dong Jiao Yu) term does not result from a criminal conviction. Administrative organs, rather than courts, impose re-education through labor. It is important to distinguish re-education through labor from labor reform (Lao Dong Gai Zao), which is a sentence meted out for criminal offenses.
