Hi guys.

Okay, today I received my Employment Authorization Card - coincidentally a year ago to the day I attended my interview at the US Embassy in London for my Fiance Visa. The question I have is this: When the card expires next July, how soon in advance would I need to apply for an extension and do I have to go through the same process as before (well, in this case I applied with my adjustment of status)? I know it might seem a little premature to be talking about such things, but after the long and arduous journey thus far I'm just trying to make sure I'm ahead of the game for the things I have to do in the future. Any advice would be appreciated.

90 days prior I would renew.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I would think you will have been approved for your AOS before you would need to start thinking about renewing your EAD. It is rare for AOS to take longer than 12 months these days.

You also might want to update your timeline as it says you are applying for a K1.

I would think you will have been approved for your AOS before you would need to start thinking about renewing your EAD. It is rare for AOS to take longer than 12 months these days.

You also might want to update your timeline as it says you are applying for a K1.

It is more rare than it used to be.

But if it should occur, the standard guidance would be at least 120 days before expiry of the EAD.

Not nessasarily, its been a year and four months and I am still not approved! And yes I have made several info pass appointments to find out whats going on. You are not going to nessasarily be approved within the year!

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

You can apply very early if you wish...up to 6 months and from I've read around the forum they'll still tag it to your expiration date which is helpful.

This is INCORRECT. If you file too soon, it will be denied! You are only allowed to file for a renewl 90 days prior!

Not necessarily true. I've know people to be shorted on their date.

They also don't pick up where the date leaves off. If you file to close in to the 90 days you can end up with a lapse in authorization.

Yeah I should have made sure I was referencing something that was up to date. My bad. I didn't want anyone to be confused because of my error, hence the official link in post 10.

That's why it always pays to revisit a post...you might find your information is old or worse completely off.

Is the fee waived for a renewal EAD for someone in AOS or do they have to pay for it second time around?

If you look here :

The last line says: If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $340 filing fee.

That infers that there is no fee for you if your application is after July 07. Can someone confirm this?

Not nessasarily, its been a year and four months and I am still not approved! And yes I have made several info pass appointments to find out whats going on. You are not going to nessasarily be approved within the year!

Wow! I think you're case might be lost. Have you tried looking up any info about your case at the USCIS website? I know that it's not updated most of the time but maybe it could enlighten you.
