and ive heard she need to publish her bc to a news paper...you better start now or wait a long time.

hehehe.. ikaw naman ate tinatakot mo masyado yan hindi namn ata ganon un hehehhe... :bonk::lol:

heller...yung mga klasmate ko sa college ganun ang ginawa nila para macorrect yung bc...kasi part yun ng process for correction ng bc...anu ka ber.....hhehehhehe

CANCELLATION OR CORRECTION OF ENTRIES IN THE CIVIL REGISTRY

SEC. 4. Notice and publication. - Upon the filing of the petition, the court shall, by an order, fix the time and place for the hearing of the same, and cause reasonable notice thereof to be given to the persons named in the petition. The court shall also cause the order to be published once a week for three (3) consecutive weeks in a newspaper of general circulation in the province.

thanks for the responses but i really wanted to know if we could do the I 129 starting the k-1 process then have her name changed while the process is going on. I guess bottom line im asking is it a requirement or does she need her birth certificate as paperwork needed for the I 129

She won't need her BC until after the I-129F is approved. She will need it for the Visa interview at USEM.

sorry but i think its not true... u need her birth certificate when u file a I-129f petition for ur fiancee... what mister bill meant is she needs her ORIGINAL BIRTH CERTIFICATE on her interview at the american embassy here in the Phil.

( coz u will submit a bc of ur fiancee when u file k1 but its ok if its not original copy, but when she will have her interview she will need an original bc to show to the co.. of course when u file a k1 in uscis and when u fill up the necessary docs. u should put the correct inputs there and what u put in the docs. should be tally to the docs. she will submit to the co..)

BC of beneficiary is not needed during filing of K-129, its more from petitioner, the beneficiary will submit all her documents on her interview date, u still have enough time to correct her BC while k-129 is going on...i had my problem on my surname b4, it took 8 months for me to change that correctly, u can ask at civil registry, i only spent 2k pesos. Thats not a big problem...GoodLuck.

if our bc is not that necessary then why they are asking from us when we submit a k1 packet on uscis..?, and if ur name is incorrect on the bc before u submit a k1 packet to uscis then the name that will be indicated in the approval notice is incorrect... then how it will be tally in ur bc after u changed it, and of course u will submit a bc with a correct name to the co... well really confused about that hehehe... but in my experienced they asked for my bc.. and i think i should i ahve a correct name on my bc hehehehe... :star:

hehehe.. well siguro pinahirapan pa sila kc ung pinsan ko di namn ganyan ang ginawa eh basta nagbayad binigaya ang mga docs. tapos after 2 weeks i think ako pa ang kumuha ng bc nya kc me prob din sya sa name nya kya pinabago sa main ko pa nga un kinuha eh... :star:

Hey,

I just read this post and thought I could help.

I've been through the same problem with birth certificate but mine is bigger mistake since it's a year. I had it to court. I get a private lawyer to handle my petition for the correction of my birth certificate, and we had 3 trials in a regional trial court. The petition for the changed of the year of my birth was filed last September 2006, and it was approved Dec. 2007 and got my first security paper on July 2008. It was such a long journey!.. And then after that, still a lot of paper works to do, since you need to forward a lot of documents to NSO Manila to get your security paper, and that is already an Authenticated Birth Certificate. If you have a correction in your Birth Certificate you can't just easily go to any NSO office and fill up some papers to get a copy of it just like what people are doing who doesn't have a problem in their birth certificate, but then every time you have to get a copy of your Birth certificate that is corrected, you have to send all those papers required to NSO Manila again...it's very complicated..so the best thing to do is to get more copies of Birth Certificate when you requests for your SECPA to save time and money. Me, I have 5 reserved corrected and Authenticated Birth Certificate from NSO Manila.

HI i was hoping someone could answer a question for me. Im going to the philippines in a few months and probably will be doing a k-1 visa. My fiancee has a problem with her birth certificate her last name is spelled wrong. Do we have to fix it now for the I129 application after we meet or just have it ready for her final interview at the embassy in manila. Also how does she get the birth certificate fixed so we dont have any problems and how much will it cost to do so.

hi.. i had mine done last year but before we filed K1 i fixed my name first. so it took me 8 months to wait though mine had a lot of complications. but if the spelling is incorrect then i think it will only take 2-3 months to wait. just let her visit the city municipal/registrar on where she was born and the civil registrar head will be the one to do it plus they will instruct you what are the things or requirements needed as proofs of the correct spelling of name as request for change of correct spelling to NSO it cost P1000 per request. no need for court hearing if it is only typo error unless change sex or whole birthdate and etc that is according to RA9048. hope this would help:

My fiancee has a problem with her birth certificate her last name is spelled wrong. Do we have to fix it now for the I129 application after we meet or just have it ready for her final interview at the embassy in manila. Hi, i have the same case with your fiancee. and it took me 3 months to process for the correction and it depends on what is to be corrected. How many letters was misspelled? If only a wrong spelling is to be corrected it could only be done between the Local Civil Registrar and the LRC will forward it to the NSO, but if it is about the Gender, Date of Birth and the whole name or last name the court will take charge of it. And since it's only a spelling its just minor, but i takes 6 months but it can be done for only 3 months it depends if the registrar is not that busy. BUT.... you can file your petition if you will not change anything on her BC. and be sure that all the required documents from her has the same name or infos based on her BC from the NSO. so, you have to choose, or let your fiancee decide it to change or not to change... And you can fix it later i think when you get married :) Think about it.
