HI i was hoping someone could answer a question for me. Im going to the philippines in a few months and probably will be doing a k-1 visa. My fiancee has a problem with her birth certificate her last name is spelled wrong. Do we have to fix it now for the I129 application after we meet or just have it ready for her final interview at the embassy in manila. Also how does she get the birth certificate fixed so we dont have any problems and how much will it cost to do so.

It's better to fix her BC now.

tell her to have her birth certificate fix before you file for k1...i dont know the process about it but i remember it will take months to have it fix...tell her to go to the place where they registered her birth certificate and ask the process of correcting birth certificate. thats it.

because i remember when i took board exam in pi some of my classmates wasnt able to take the exam because they had problem with their birth certificate some were mispelled wrong...so they waited for months to have it fix and they just took the exam on the next year.

it depends on how much its gonna cost but in pi money it cost so much too.

There was a thread about this before. You have to file a petition with the court. It will probably take a lawyer to do this because the process is complicated, and a lot paperwork is involved. It can be very expensive. Good luck.

hi..my case is even more complicated coz i was married here before and u can imagine the annulment papers to submit..but i was not told by fiance to send the BC..and so far so good...he just submitted "HIS" BC for the I129..and not mine... although i got the original BC with me with no corrections of name or bday but only to find out later that it wasnt registered at the Local Civil Registrar's Office and NSO..so i got a negative result from NSO and they endorsed it to the Registrar;s office which took me more than a month to finally get the SECPA(security paper) of my BC (for the interview or RFE's if any )...i think for the interview they need the SECPA NSO BC...

my suggestion is while u do the paperwork ready for the I129 packet for visa application, she can already go to the registrar's office (because i found out that NSO is not the liable agency for any name or date corrections--that whatever the LCR gives them, thats exactly what they issue in the paper) and address her concern there and they will advise her what to do ..

good luck and im sure the sooner u do it, the shorter the hassle and long wait...

Assembling the I-129F Package: Checklist frequent questions

Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.):

1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted.

2. Cover Letter (see example). Should include a description of what your are petitioning for (I-129F), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

3. Form I-129F: Petition for Alien Fiance(e) (see example)

4. Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it.

5. Original statements (from both the US Citizen and foreign fiance) certifying an intent to marry within 90 days of entering the US on a valid K-1. (see example)

6. Proof of having met in past two years. (click here for examples)

7. G-325A (all four pages) filled out by the US Citizen signed and dated (see example)

8. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <Insert US Citizen's Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

9. G-325A (all four pages) filled out by the foreign fiance(e) signed and dated (see example)

10. One passport-type photo (see specification) of the foreign fiance(e). Write the full name of the foreign fiance(e) on the back. Place in a plastic bag and label the bag "Photo of (insert foreign fiance(e) name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

11. Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

12. Copy of final Divorce Decree(s) or Certificate(s) for the US Citizen and/or foreign fiance(e) if either has been previously married. If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.

13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

14. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

THE ANSWER IS NO... U CANNOT FILE A K1 IF SHE HAS A PROBLEM WITH HER NAME IN HER BIRTH CERT. BETTER U FIX THIS FIRST B4 FILING A K1 PETITION FOR HER... U JUST GO TO THE NSO AND FIX THIS PROBLEM THEY WILL ASK DOCS. FROM UR FIANCEE THEN U WILL PAY FOR THE FEE, ITS OK TOO IF U GO TO THEIR CIVIL REGISTRAR BUT IT WILL TAKE A MONTHS THEM TO PROCESS THAT... SO MUCH BETTER IF UR FIANCEE WILL BE THE ONE TO DO IT... U NEED HER BIRTH CERTIFACATE WHEN FILING THE I-129 PACKET... ITS EASY DONT GET FRUSTRATED.. JSUT GIVE THEM THE NECESSARY DOCS. AND PAY THE FEE THERE WILL BE NO PROBLEM... GOODLUCK...

N-400:

She won't need her BC until after the I-129F is approved. She will need it for the Visa interview at USEM.

sorry but i think its not true... u need her birth certificate when u file a I-129f petition for ur fiancee... what mister bill meant is she needs her ORIGINAL BIRTH CERTIFICATE on her interview at the american embassy here in the Phil.

( coz u will submit a bc of ur fiancee when u file k1 but its ok if its not original copy, but when she will have her interview she will need an original bc to show to the co.. of course when u file a k1 in uscis and when u fill up the necessary docs. u should put the correct inputs there and what u put in the docs. should be tally to the docs. she will submit to the co..)

heller...yung mga klasmate ko sa college ganun ang ginawa nila para macorrect yung bc...kasi part yun ng process for correction ng bc...anu ka ber.....hhehehhehe
