I was wondering if it would be okay to call this number and ask them if they can add to the I-9 something about k-1 and the "work authorized" stamp they are still giving at JFK. Cause according to SS k-1 visa holders are authorized to work.

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

Actually they just recently (February, 2009...effective April, 2009) CHANGED the I-9 so that it WOULD NOT apply to K-1 visa holders. The recent changes were specifically designed to exclude K-1.

The K-1 is NOT and never has been a "work" visa. If you filed for a K-1 in the mistaken belief it WAS a work visa, rather than the CR-1 which DOES authorize work, then you were mistaken and the government does not need to change any rules because of a mistaken belief on your part. (in fact many people WERE mistekn in this belief which is WHY they changed the rule to clarify that K-1s are NOT eligible to work)

Regardless of what the SS adminstration says, the SS administration does not determine who is eligible for work. DHS does this. That is why your fiancees new social security card will say "not valid for work without DHS authorization". The SS ruling basically means your fiancee is eligible for a SS card immediately. She is, you can get the SS card and I suggest you do, but she cannot work until she has a green card or EAD.

Incidentally, our oldest son (18) entered JFK Thursday (K-2 to follow) and was given the "employment authorized" stamp. You shouldn't apply too much credence to this stamp, it never has meant anything in itself which is why they still give it. Without another type of work authorization it never was valid (though it was mistaken to be so by many people) and therefore is neither fish nor fowl. Without "something else" it is worthless. WITH something else, it is worthless. Basically, it is worthless. One may better spend time writing to JFK and ask them to stop wasting ink.

Incidentally, our son, as a K-2 is not even eligible to receive a SSN until after his green card. Our 13 year old also had an "employment authorized" stamp on his I-94 when he entered last September.

I read just yesterday in the RU forum that the stamp is no longer being given at all.

As of last Thursday at about 5:45 PM EDST at JFK airport, it was given tou our son entering on a K-2 from Ukraine. We did not ask for it. K-2s, were never under ANY intrepretation, allowed to work.
