Hi

heard on the phone with NVC that we have RFE

NVC says we have not send 2008 tax return

true

My husband sent 2007 tax return plus a letter from E&Y saying they have not filed yet (for double taxation reasons)

maybe letter was not very good E&Y did not say when they expected to have filed, letter was end of My and we sent info end of June

we don't have the elements of the RFE exactly

will not be able to check paper mail until end of July

not 100% sure they sent letter maybe email will come

we have case forwarded to supervisor for certified copy issue on the wedding certificate

(again no email or mail was received, was not told the word RFE, I did send email confirming I did provide certified copy)

should we

wait for email / mail (nooo please, I hear it is a waste of time to wait for paper mail)

email on this (maybe read earlier?)

or go directly to paper mail (is mail the media for RFE?)

Ideas

1-send email

pointing at evidence they have

that letter says 2008 not filed yet

and that 2007 return shows it was filed in Nov 2008

2-send email

same than 1

but with a new letter from E&Y saying they have not filed yet still and when they expect to file

so that NVC should not wait on it and 2007 is best info

we can have new letter from E&Y by pdf tomorronw

a paper letter might take until Monday

3-send paper mail attn DR for RFEs

with a coversheet done from website

with same info than 2

should we go direct to paper

or keep it email 1 or 2

or do email 1 and then paper 2

As I feel first letter from E&Y was not convincing

I think would go email 2 or paper 2

email 2 could gain us time vs time to receive paper from E&Y

then when paper received would send as paper

thinking aloud sorry

October 10th entered US with Visa Waiver Program for 2 weeks holidays (not usual with visa received!)

had to go through secondary inspections to explain

November 25th entered again US with WVP, officer did not notice my green card visa

left US on dec 28 to avoid meeting the substantial presence test for IRS

Jan 9 2010 entered and activated green card though PHL port of entry

waiting for SSN requested with DS230 and 10 years GC

01-30 received tracking number for GC Welcome issued on 01-27

but not yet SSN

SSN expected by Feb 20 else I might go and ask for one regardless of DS230

GC expected by March 27

Feb 3 2010 update card ordered says to allow for 30 days

Feb 8 2010 update saying approval notice sent

Feb 12 2010 received GC card Permanent resident valid till 2020

Feb 18 2010 went to file ss5 for ssn card as not yet received and center would not find me in ssn files

just got the RFE by email

wondering if talking to operator and mentioning I had not received it yet was a factor

Anyway noticed that other emails were slower than AVR by several days so it seems usual

not sure if worth sending email for explanation about the missing tax return

already did escalate to supervisor and sent email for the wedding certificate that is part of the checklist

is it worth sending email? or just go on paper direct?
