Hi to anyone that have time to read my post.. i just wanted to make sure im filing the right papers or atleast get a second opinion.. my story right now... im already a us citizen but studied highschool and college in the philippines had a long term girlfriend since my senior year in highschool.. from the year 2000- present weve been bf gf.. i went back to the US 2007 to find a better job.. got a job.. then this year.. she decided to come here in US to visit me.. she came feb 2009... and will end her 6 months stay aug 25 2009... since weve been together that long and I didnt want to file a fiance visa anymore i asked her to marry me.. she said yes... we got married just this july 8 2009.. we still have 1 month left before her stay expires.. and ive herd that if we hire an attorney they can make it work for us that she dont need to leave the US.. attorneys tough are a bit too high on the price and was wondering if i can do it myself.. i found this link http://www.visajourney.com/forums/index.ph...page=i130guide2 so the questions now...

1. I-130, G-325a, I-864, I-485, I-765 (optional), I-131 (optional) should i file this papers one time big time or is there a sequence that i have to wait for each paper to be approved.. if so which forms go first?

2. Evidence of a Bonifide Marriage.. we really didnt live together in the Philippines since asians mostly live with parents so the only thing i can think of for proof are pictures of us together.. lots of them... is that good enough or what else can you guys suggest?

3. should we hire an attorney or you guys think we can do it our selves and save us atleast 2k$?

please help.. i dont want her to go back in the Philippines as much as possible bec...her going back to the Philippines will mean... one... longer for me to wait till she gets back.. two... chances of guys flirting with her is big and any temptation on both parties can cause family separations... i dont want to take those chances if i can do something here already..

Yes u can do everything by yourself. My situation is quite similar to yours. I came here on B2 visa and now i have my greencard. I did everything all by myself with the help of VJ.

1. Yes you can file all the forms concurrently, just make sure you have all the requirements.

2. The most important evidence is your marriage certificate. Wedding pictures and photos of you together will help. Also, if you have joint bank accounts, credit card/utility bills, lease agreement or anything under both ur names... it's a big plus.

3. Your case is not that complicated to hire an attorney. Just read the instructions on the immigration forms carefully and you'll be fine. If your not sure of what to do, a lot of VJ'ers are willing to help.

First of all I REALLY REALLY want to THANK YOU guys for taking time to read my post. i just wanted to make sure i got this right.. cause LEN said i just need a change of status which is I-485... but visacheck answered my question number 1 i can file all the forms concurrently which are I-130, G-325a, I-864, I-485, I-765 (optional), I-131 (optional).. which forms should i really need to fill up.. if somebody can give me a List or a link it would be very much appreciated.. sorry for asking too many stuff.. il also do my best to read some more stuff in the forums .. thanks again God Bless :innocent:

You need to file all the forms you list but you are not petitioning for a visa, you will go directly to greencard

"Adjustment of Status" is the entire process. Im sure that's what LEN meant. In order to adjust status you need all the forms you mentioned except for the optional I-765 and I-131... but they're free so might as well. You also need form I-693 (medical examination).

You don't say what type of visa your wife came on, but I am guessing a B visa if she came to visit you. You will have to prove that she didn't come with the intention of getting married. This is easier in your case considering that you waited several months after entry before marriage. Just something to consider. Try to gather convincing evidence that when your wife came to the USA, she was intending to go back.

This is due to the fact that the ability to adjust status while in the US requires that you entered legally and are not out of status. Obviously, you have to file for adjustment of status before her visa expires. But if your wife entered the USA with the intention of marrying you, then she entered illegally if she didn't use a K visa. I'm not trying to make accusations here, just letting you know the law and what you will need to prove in order to successfully adjust status.

Thanks for all the replies. really reallly appreciate it. im finishing up all the paper works. i was so busy at work but.. SMR, yes its a B visa.. i guess the only proof we can give them is... this is her second time visiting the US and if it was her intention to stay she shouldave done it the first time.. if thats not enough i dont know what else to say.. but if theres any suggestion or examples to prove them it wasnt really planned please post a reply.. im rushing now to go to work. thanks again everybody
