EAD - when to apply

Timeline

Is there any advantage in filing for an EAD (I-765 form) at the same time as filing for adjustment of status (I-485 form)?

My reason for asking is that I could file my I-765 today, but my I-485 package could take a couple of weeks to get together. If I file seperately, but nonetheless close together in time, could this cause mix ups or hidden delays?

If I am not mistaken, you cant apply for the EAD before you apply for the AOS. It will also save you 1 biometrics fee.

If I am not mistaken, you cant apply for the EAD before you apply for the AOS. It will also save you 1 biometrics fee.

There is the biometric, but it's $70, which is manageable.

I'm more concerned by concurrent filings causing problems. Has anyone done it this way?

The applications are processed separately, so there shouldn't be any problem filing them separately.

Ok, thanks.

What would be marvellous is if filing seperately was quicker than filing together. Or vice versa even. Just some way of cutting down the 2 - 3 month wait time for an EAD.

Because without an EAD, I can't get a SSN. Without an SSN I can't get a darn bank account in my name, title a car in my name, or do a whole bunch of stuff. TO WAIT 3+ MONTHS FOR A SSN IS JUST KRAZY. With a capital K :wacko:

I'm interested in why K-1 holders don't need an EAD for an SSN, but K-3's do. Anyone know??

One does not need to send a $70 biometrics fee with the I-765 application, despite what the USCIS web site seems to say.

Johnny - my K3 wife submitted her I-765 ahead of submitting her I-485. Just be sure that you select the correct basis for the application.

That's right, it'd be an a9 submission instead of a c9

How long did it take for your wife to receive her EAD? Was it less than 2 months, or more than 3?

It took a lot longer than 3 months, but was it was an unusual case in the way that someone at the USCIS screwed up and made an error. It was also well over a year ago, so in any case the processing time would not be relevant today.
