Hello,

I am currently in the US on my K3 visa. I am getting ready to adjust my status. I called the NVC today to confirm if I had the approval notice for my I-130. I wasn't sure if the notice I got was an approval or if another one was supposed to come.

Anyway, the lady told me that I did have the approval notice and I could apply to adjust my status. She then told me I need to email the NVC to tell them I am going to adjust my status. She said "just email us and tell us you are currently in the US on a K3 and you will be adjusting your status. Also include your new mailing address in the US" The lady also told me that I can't file to adjust my status until I do this. Is this true? I have no problem emailing them but I don't want to mess my case up in anyway. Did anyone else do this?

Also, do I need to send the original notice of approval or a copy with my package to adjust my status??

Thanks for your help!!

Terri

You have a choice in how to proceed in getting your permanent resident status. If you choose to do the AOS way instead of consular processing, then you can file the I-485 to the USCIS with a copy of your I-130 Approval Notice (NOA). When you do this, then yes, you send the NVC an email stating that you have opted to file an I-485 in the US and wish that your I-130 be sent back to USCIS.

It doesn't screw up your case in any ways. It's what you're supposed to do...

You don't have to.. when the USCIS processes your I-485, they will know the I-130 is at the NVC. By sending the NVC an email telling them to send it back to the USCIS, you speed things up a little bit..
